Placed an Order and Store Called Back to Say They Can't Do It for That Price

Good day OzBargainers! Just wanted to discuss and receive some advice.

I purchased a pair of speakers here

PSB Passif 50 ($1999), RRP for $4999 and most places selling it between $4100 and $4200. After placing the order, I received a call a few hours later advising that they're unable to sell it to me for that price and offered to sell it to me for a higher price. (It's not unusual for speakers to go on sale for 50-60% off, even currently most of the focal range is on sale for 40-50% off the RRP so it didn't strike me as a pricing error)

In everyones experience, what usually happens in these cases? Can a seller just cancel the order and not honour the pricing? I'm not sure if Audio Influence is a reputable seller or not but has anyone had any experience with them?

    It was probably a pricing error on their end. At least they had the courtesy to call and notify you. They could've did what most places do - just cancelled your order and put you on hold for hours when you try to contact them.

    and yet you're still shocked they are cancelling the order when its half price of everyone else.

      As I mentioned in my post, speakers are quite often on sale for this sort of discount. The markup on speakers are massive and the sale prices are normally the 'correct' price. If speakers arent in demand then many stockists will reduce them to clear. Dynaudio, focal etc quite often go on sale for half price

        Then take your business elsewhere.

        At the end of the day, you can't FORCE a business to sell a product to you at a price you want.

          But you can force a company to honour a contract.
          And that is really the critical issue here - does OP have a concluded contract.

          I think you're missing the point. They were listed for a good price and it suited my needs so I bought them. I didn't force them to list it for that price nor did I force them to honour the price.

          This is the first time it has happened to me so I sought advice from the ozb community. Now I know for next time

            Well you are, as this is your entire point of your post, they cancelled and you want the speakers at that price. How can they legally do that to me.

            Pricing mistakes not being honoured are very regular occurrence on ozb, so I'm surprised this is the first time you are seeing all this happen.

                @odd1out: Not having a go at you, you seem to think the pricing should be 'valid' as every now and then they go on sale but the retailer is saying no. ACCC says retailer can cancel for pricing errors. /thread. Nothing you can do about it.

                Put it another way, the supermarket has 1/2 priced sales too, but doesn't mean I get that item 1/2 price when its not on sale.

    Doesn't seem like a reputable seller if they are willing to try to pull this off. When you price something too cheap, and then they bump up the price like that after the sale, there is a word for that. Predatory pricing.

      Predatory pricing is when you drive out the competition by selling things at a loss so no one else can compete.

      What you're thinking of is bait and switch.

    If Audio Influence has been notified of the incorrect price and have confirmed they are aware of the error and failed to take steps to correct it - then continuing to advertise it to the public at a price that they are not willing to honour is misleading and deceptive conduct regardless of the contractual issue.

      Yeah they are racking it in with all those cancelled and refunded sales they are getting.

    I had something similar recently where they wouldn't honour the price they had offered the goods at, even though I had already paid they wanted to refund me, it was an online sale, so I wrote to the big boss of the organistaion, he let me have the goods for the price I had paid. The power of the letter!

    Classic bait and switch pricing. Pretty sure it is illegal now. Check with ACCC

  • The real problem with these scenarios is there is no recourse. ACCC won't deal with consumers directly, they're more of a watchdog and regulator.

    Fair trading won't help you out unless there is a bunch of complaints received about that retailer.

    So, at the end of the day, you have 'consumer rights' but no way to invoke them. Only avenues are negative reviews and social media, back and forth communication at a pest level or personally funded legal advice if applicable.
