Non-U.S. citizen: when the prize is awarded to a non-citizen, there is a Five step process that must be followed. 1. The “WINNER’S AFFIDAVIT OF ELIGIBILITY AND LIABILITY/PUBLICITY RELEASE" Must be signed. 2. The IRS Form W-8BEN is filed by the Foreign national prize winner to report the amount received and the 30% withholding in the prize Value. 3.Overkill will Collect the 30% of the prize Value to be withheld for taxes. 4. Overkill must fill out the IRS Form 1042, reporting U.S. Source of Income by Foreign Persons. 5. Overkill will collect the shipping and insurance fees associated and then process shipping.
Other US based international Gleam comp T&Cs usually have a generic line about " Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner. "
Now that I know what that entails I'll be thinking twice about the value of entering US based giveaways. I guess smaller giveaways by influencers might not bother with all that, but it seems like larger companies do, or would possibly try to not select international entrants as winners because it's more hard work.
