OurDeal is promoting Counterfeit Goods

I see that OurDeal are offering counterfeit Calvin Klein.

I emailed them by their Contact Us form last night, but (other than an automated 'thank you' response) have not received any reply.

Today I note that over 350 'buys' have been made, and the offer is still active.

Who does one contact about this illegal activity? The state Police? The Feds? Of course I will contact Gazal Corporation (the Australian distributor, I believe), but if the promoter ignores the law what does/can an Australian consumer do?

      Well, common sense, because of the price. Also, one look at the web pages (that are hanging off a free web hosting service's website) shows all the other counterfeit goods being offered for sale. These other counterfeits are also being promoted for sale on the OurDeal site ->

    The shop in question is Blu Savvy, which does not look very trusty (no ABN, no contact info, etc). They do list out their cK items here:

    With images showing Calvin Klein tags. I guess they are trying to prove their genuineness. However other items on their site are questionable. It has been pointed out in the unpublished deal that they are selling fake LV bags that they even say on their own web page:

    This may not be the real thing, but no one will ever know the difference!

    That concludes their lack of credibility. I think OurDeal needs to be contact as they are the middle man. Maybe someone with a bit of detective skill can find out who Blu Savvy are.

      I did contact Our Deals Pty. Ltd. I used their Contact Us form on their website, and I wrote to their domain contact as well. No 'real' reply so far.

      The contact phone number given here on OzBargain (02 8517 0580 - http://www.ozbargain.com.au/forum/ourdeal.com.au) either gives a 'busy' signal, or a message that the number is no longer in use.

      The OzBargain REP for OurDeal "OurDeal Ambassador" has not been on OzBargain since May 16th this year.

      I contacted CK's Australian distributor for their underwear range. It seems that they have the Australian rights for the CK trademarks. (I think it would not be copyright infringement).

      I am not sure if Gazal Corporation has "a wad of surplus cash".

      In any case, it is the Police who should take action. Counterfeit clothing is no longer a civil mater. it is unlawful to sell or supply, display for sale or supply, and even to buy, counterfeit goods. I think the law changed in 2000?

      There are about 500 consumers being duped into buying what they thing is genuine Calvin Klein garments.

        'Imitation in the sincerest form' ..Any event: Hard to see one being duped/devalued, apart from maybe, 'the brand', concerned- and which would be the task work for a trademark personnel.

    We can't, and you are right - 518 taking up the offer may mean more than 2,590 pairs. I don't think that there was any limit to the number of 'deals' one could buy. Some buyers may have ordered more than one set of five pairs.

    and that it is

    "Calvin Klein underwear"

    and that they are

    Civil action can be taken over the trademark issue. However, as I mentioned previously, it is also a criminal offense to sell, supply, display for sale or supply, counterfeit goods. I guess the passing off could be another offense?

    While technically this is shown, what customers are being told, it does not necessarily follow, that which is claimed (true) is being believed. Possibly, a court could find the difference, apply injunction &/or penalty, but who is legitimately complaining. Surely it is Calvin Kleine's.

    I neither agree with -or- countenance, my "telco" misleading me - to think that "the value of the item" - 1 Sim card: voucher - is worth 500.00 value, but all this is too common. Artificial value creation again.

    I could suggest the same about micro-memory cards & their artificial inflation - brand, speed class rating, etc there exist a host of marketing BS implied. Yet, few of us are under the illusion the stated products provided, reflect real or tangible value.

    OurDeal have been removing any posts from their Facebook page that reveal that the CK stuff is counterfeit. They then blocked the poster.

    Just now they have at least stopped selling the fake items - they stopped the sale two days early at "530 deals" - Just short of $26,000 in sales.

    They have now removed any mention of the deal from their Facebook page.

    There was no "Last Chance" announcement, as is always the case with their deals, it just 'disappeared'.

    It appears that OurDeal are attempting a 'cover-up'. Instead of responding honestly to the Facebook posts, they remove them. Will they refund the $26,000 to their customers? Or will they keep it and supply the counterfeit CK ?

  • I have also had a bad customer service experience with OurDeal. This was back around March and prior to the experience, I purchased from them a lot.

    Their poor customer service has cost them a fair bit of money I would say. Interesting to read they are apparently blocking Facebook comments now.

    How about answering customers and providing good service, OurDeal?

    OP - you pretty much got the best you could out of this action you have taken. While the tone of some of the other readers seems a bit negatove, I applaud your concern.

    At least they stopped selling about two days 'in' - instead of the five days I think they had planned.

    I had to contact OurDeal (but was at first ignored and then lied to), the TEN Network (who could see that it was a scam, but had difficulty in contacting OurDeal - a company that they own), and Gazal Corporation (who, I was told, passed it to their legal representatives).

    I would have preferred that OurDeal has admitted their error (that they had been lied to by the supplier), announced that they would be refunding the buyers, and said that they would be more careful in future.

    The fact that OurDear removed all posts on their FaceBook page that revealed the scam, makes it look like they were 'in on it'.

    I don't think this type of scam is covered by them. Surely a matter for the Police and/or a Trademark infringement action by the Trademark owner.

  • It's not even a real website! It's hosted on Weebly, a free web host provider. Blusavvy could have at least made just a LITTLE more effort to look less dodgy.

    As for OurDeal's form … pretty poor. Even if OurDeal was duped, surely they could have handled it better when they pulled the deal. To just censor their FB page and then quietly try to sweep this under the rug is not a good look.

    I am not so sure that the deal has been "pulled".

    They may have stopped the promotion, but still intend to keep all the payments and deliver the fakes.

    OurDeal are still attempting a 'cover-up', and it seems that they will be keeping the $26,000 in sales and delivering (via their merchant) the counterfeit goods.
