HYPE DC Withdrawing My Rewards

Long story short, both my wife and I purchased shoes from hypedc and we supposed to received 2x$40 hype dc rewards as part of the tier member. However they withdrew the rewards because of the following reason:

I've received feedback from our merchants team who have conducted a thorough investigation on your account as well as previous orders made. I'm sorry to advise that we have withdrawn your accrued loyalty rewards. Your rewards have been withdrawn In line with our Loyalty Terms & Conditions, orders that we suspect are intended for commercial sales, including any rewards earned or applied will be cancelled.

Point 3.4 and 3.5 of our Terms and Conditions states that:

3.4 If you don’t adhere to these Terms and Conditions, Hype DC reserves the right to cancel your Hype LIMIT’D account and any associated Rewards at any time.

3.5 Hype DC reserves the right to withdraw, cancel or vary the Rewards offered to you within the Program at its discretion, including Rewards awarded in error or earned fraudulently. Hype DC will make all reasonable efforts to communicate these changes to you via email or the Hype DC Australia website.

I'm sorry that this was not the outcome you were hoping for.

All the shoes i purchased from Hype are for personal use (according to my purchase history, i bought more shoes in footlocker then from Hype) and never intended for commercial sales. I can even send a proof of evidence to hype but they no longer responding to my email. I can recommend you to reconsider your purchase somewhere else, never consider tbuying anything from Hype.

    • Sounds like a reseller/scalper got his due and got banned. More shoes retailors should follow Hype and do this.

    Cool, they don't seem to think so. How many have you purchased in the last 12 months?

    You've raised a flag with them based on your purchase history.

    Rewards programs are private things created by the businesses, they can do whatever they want and you don't really have any room to appeal because it's not money and it's not a legal thing, so yeah, you're out of luck if they don't overturn it on some sort of 'appeal'.

    You probably won't change their mind, but I would send them proof anyway. Photos of yourself while wearing all of the shoes you have ordered from them, and even with today's newspaper for the date.

  • That’s odd. There must be something which created this flag, and the investigation must be presented to you in full.

    Ask them for
    1. All documents related to allegations of breach of terms related to your account, any investigation and results.
    2. Tell them they’re acting in bad faith and their claims could be construed as deceptive and misleading conduct under ACCC.
    3. Give them 30 days to either, send your rewards as per the originally agreed terms or provide the documents requested in point 1 which you will include in your complaint to your local NCAT/VCAT/QCAT as well as ACCC.

      • Under section 24 of the ACL, a term in a standard form consumer contract is "unfair" if it:

        it would cause a significant imbalance in the parties’ rights and obligations arising under the contract; and
        it is not reasonably necessary in order to protect the legitimate interests of the party who would be advantaged by the term; and
        it would cause detriment (whether financial or otherwise) to a party if it were to be applied or relied on.

        Unilateral contract term variations are unlawful and will be illegal under consumer law this year.

        • Pretty sure that's not a consumer contract, it is a contract for the bonus dollars scheme, which can be signed up to without buying anything.

  • Bought 6 pairs last year in total combined with wife's purchased. 3 pairs (combined) in Jan. All purchased pairs are still here with me.

    No investigation no documentation no notification, they just took two coupon rewards out of the blue. And yes, have sent photos to hypedc, but they ignored all my messages.
