Government department to contact for faulty eBay purchase

I bought an item from eBay Australia that has died within the 1 year Australian warranty period. The seller is not responding to my message asking for a refund and eBay chat wiped their hands of it.

I would hope that Australian consumer law has the purchase between myself and eBay and therefore that they can be compelled to issue a refund.

Can anyone suggest which government body to contact, that will deal with this issue?

    Good luck. Will be a lesson to not buy off random sellers on eBay.

    When someone buys a product from a seller on your platform, they enter into a contract of sale. Your online marketplace is not part of that contract between buyer and seller. Therefore, the seller is responsible for complying with consumer guarantees.

    Also, if it was a private seller, then none of the guarantees apply anyway.

    However, if the seller is just an individual making a one-off sale (therefore, not engaging in trade or commerce), they do not owe those guarantees to consumers.

    The seller may not even be located in Australia. Good luck. With the detail you've provided here there's no way of telling if there's any basis for fair trading to intervene.

    Was it from a private seller or a business?
    Was the product new, refurbished or used?
    Did they specify warranty?

    Say you bought a pocket radio at a flea market. Is the council responsible for refunding your purchase if it fails within the warranty period?

  • There is nothing you can do about it. Don’t waste any more of your time searching for a solution, because there isn’t one. Warranty doesn’t mean anything on ebay. PayPal will only refund within 6 months.

    Best to just move on with your life.

Which in turn made me think you assumed there was a magical 1 year warranty on anything you buy from anywhere. You were very vague in the description.

    Was it new or used?
    Purchased from a private seller or a company-run account?
    What's the product?

    Also the only government body that will 'Deal with the issue' for you is a Civil and Administrative Tribunal who will deal with the issue after you plead your case, provided that it's ruled in your favour and after you have paid a application & hearing fee…. If memory serves it's $900+ to get your day in front of a judge

    The only other body that will 'Deal with the issue' for you is a lawyer, which will likely far outweigh the cost of the item itself.

    Also eBay Live Support would have just informed you that you're out of the 60-day eBay money back guarantee, which you agreed to when you purchased the item from their site so no @mikeadwell they didn't 'wipe their hands of it' and are simply quoting the T&C's which you agreed to (Technically)

    Would ASIO count as a government department to contact? I'm sure they'll be able to track down the seller…or if you ask nicely may even break into the seller's bank account and process your refund!
