[WA] ICWA - Insurance Commission of WA rang and wants to Discuss about Motor Vehicle Accident (MVA)

I was involved in car accident in late oct 2022.

Another driver was tailgating me and then he overtook me and slammed the breaks. I rear ended him, so I am at fault.

At the scene of accident, I was trying to call cops @ 131444 but everything was so overwhelming that I couldn't get through until I got home. I did tell cops that person was drunk and gave them his address, but I think nothing was done.

I lodged the crash report straight away. I didn't go to doctors until after 2 weeks where I have been told that I have stage 3 ACL.

Today, I have received a call from ICWA and they arranged a meeting with me next week. I was told that the other party put a claim for personal injury. I am stressing right now that it will be expense out of my pocket even though person over the phone mentioned that we all pay CTP so it will be alright.

Anyone had similar experience.

    Just checking, did you check what number they called from…?

    • Mobile number and asked me to save his number.

      He knew my name, accident date and address.

      • Did you look this number up at all? The person you crashed into would have all of that information.

        Do you have insurance? Did you file a claim? Did you have a dash cam?
        You're legally required to have 3rd Party Personal insurance to register a car, which would cover this person's alleged complaint were they not full of crap.

        If someone is as you claim drunk and brake checks you, I'd say you wouldn't be at fault for an accident. But that's another topic entirely.

          I had 3rd party insurance and no dash cam. Person was saying that I was covered by CTP and nothing would be out of pocket

      • Right, well as above, I'd be checking up on that. WA registration includes 3rd party insurance:

        When you pay your vehicle's licence, part of the fee is for compulsory third party insurance. This covers you, or anyone else, for death or injury if your car is involved in an accident. However, it does not cover you for damage to your car or anyone else's.

        Unless they think the other guy is trying to scam the system

        • My 3rd party insurance will cover the damage to the car and this CTP should cover the person. What I am worried is, website says that there is a cap on reimbursement on medical bills and stuff, if it goes above that, then I might have to pay for it.

          I do think that this person is not doing the right thing as he was fine after the accident but I am not sure.

              And, actually now I think about it, I did feel fine after the last crash I was involved in (their fault) and the pain only came through a few weeks later too.

            This seems unlikely. As others have suggested, I kind of suspect the Insurance Commission may have questions on this case but they may just be doing their everyday due diligence. Caps on reimbursement protect the taxpayer. Consider your answers and answer the questions honestly. It seems like you are causing yourself stress over nothing. Viewing the other driver as trying to scam the system isn't going to help you in the long run.

            Your facts are pretty straightforward:

            Stick with those. Getting legal advice is never a bad idea (I'm not a lawyer). But it seems most of the anxiety and issues with this are in your head. And I reckon many others have done this process without a legal advice.

  • Did your car have full comprehensive insurance at the time?

    If you had comprehensive insurance then much simpler because your insurance company takes care of the process and pays out any claims though you have to pay excess if you agree to take the blame.

      I had 3rd party insurance and I have paid excess already.

      This is in regard to bodily injury.

    • I emailed ICWA with person's phone number and name and just now received call from ICWA landline stating that person works for them and it is genuine.
