Street Parked Car Hit from behind - Need Advice

Hey guys, my car was street park outside our house this morning and another parked car behind it was hit by a Ford Ranger which pushed the other car and hit mine, the back of my car was smashed and flattened. Think I can still drive it as I was able to move it away from the car behind.

I have all the driver at fault information (he is with Budget Direct).
I got a 3rd party property insurance and NRMA gave me 2 options, one is to chase after the driver's insurance or claim in NRMA, and they can provide me up to 5000 dollars of loss and damages compensation.

Need some advice:

  1. Dont want to risk driving my car as I have a baby, can I get car rental and make the driver's insurance or my insurance reimburse the payment? Dont think NRMA offers it for 3rd party insurance.

  2. There's a car seat and a pram at the back of the car, can I buy a new one and claim for those to his insurer?

  3. I know insurance company would try to minimize their cost so Im thinking of getting help from tpclaims.com.au , anybody tried them before?

    Regarding #2, I know with AAMI, you get the car seats replaced. I’ve done this 2 times, both not at fault accident BUT I had comprehensive

    I would be wary to drive your car in that state. Anything designed to absorb an impact has already done so, if you get hit again you could get really badly injured. Wait till it is repaired.

    Regarding your questions I am not sure to be hoenst, tough situation :/

    Are there any no win no fee compensation lawyers near you?

    • Thanks! Not really sure as I only searched online and saw this website sayng I might be eligible for compensation for car hire if Im not at fault. But Im still waiting for someone with experience with them.

    Hope other driver is ok, Claiming hire vehicle likely, look at right to drive. (https://www.right2drive.com.au/our-branches)
    Pram maybe if damaged in the boot, car seat likely no as not in use at time so wont have suffered any damage.

      I think you’re supposed to scrap car seats if they are in an accident. So I am sure they will be covered by insurance.

    You have two options. Doing the legwork and claiming yourself or claiming the $5k from your insurer.

    You have now found out why comprehensive is a better choice if you can afford it.

      • yep, looks like it, also having trouble opening the 2 rear doors. its a 2005 toyota corolla so value might be less than 3k.

    Being able to drive…'move it' and being Roadworthy and safe are two very different things.
    A cracked Tail light lens is Unroadworthy. Sharp edges are Unroadworthy. Impact 'flattened… definitely Unroadworthy.

    As for the Insurance and Legal questions, ask the appropriate Insurance Companies directly.
    Only they know their Terms and Conditions for each Individual situation.
