Purchase on Catch Marketplace seller, Now They Are Asking for More Money

Hi all,

I purchased and paid for an item on catch of the day.

I received an email saying they listed the product too cheaply by mistake and now would like further payment.

Is catch of the day obligated at the sale price or can they claim that the sale price was an error and demand more money?

    They can sell it to you at that price or they can cancel the sale if it was a genuine error.
    Asking for more money is simply bad form and something I’ve only seen dodgy Aliexpress sellers do.
    I’m guessing it’s sold by third party seller on Catch?

        Make a complaint to Catch and see what they can do to help you out.

        Review the terms of sale. If the payment has been cleared and the order has been accepted, legally, there's nothing they can do but ask you to pay the extra. Outside of that, it's usually a breach of contract as you've completed your side of the contract (clearing payment) and they've completed their side (acceptance of the payment and confirmation of the sales order).

        I've had numerous sales pushed through in this same situation, and while they try and get out of it, you simply go back to them with their own terms of sale as there's nothing they can legally do about it. Unless of course their terms have a clause to get out of it somehow.

        Know your rights and look into their terms first. If they are in breach of their own contract, you just tell them you'll go to ACCC and Fair Trading and see what they do then. Every time I've been in this situation I have come out in front - with the discounted price and the item. The victory is worth the effort :-)

    Just get a refund, not worth dealing with dodgy sellers

  • Depends.. was an obvious price error like paying less than 20% of the value of the item?
    Did they already fix the price or is there a chance they are doing it on purpose to appear on the top of the search and then try their luck?

    Me personally, if it seemed like a genuine mistake I’d just ask them to cancel the order or pay what they asked if it is still reasonable and I wanted the item for that price.
