Are "Sitewide" Sales Advertisements Misleading?

One of my pet peeves recently is seeing shops and companies advertise "sitewide" sales, but they're always followed by exclusions. Some will specify the exclusions, while most will just make you enquire about what exclusions there are.

I feel like it's getting to a stage where it's just downright misleading. I understand sometimes it's reasonable to exclude products, but some of these "sitewide" sales have such a long list of exclusions it really contradicts the term "sitewide". So I'm wondering if anyone else is feeling the frustration and also whether you think this could be a legitimate complaint to something like Fair Trading?

  • My pet peeve is: UNLIMITED DATA!!! * (xx GB/TB fair use policy applies.)

In terms of yours, there's apparently been an incident raised by the ACCC of exclusions not being clearly advertised: https://www.accc.gov.au/media-release/misleading-mitre-10-st…

So it's probably why every retailer now clearly states the exclusions and it seems to be an accepted practice.

"Sales on approximately 20% of our range of products excluding the usual important sale" is more than enough and more accurate.

But what do I know, can't find a job in marketing for some reason

Get others opinions and investigate if worth raising with fair trading? Atleast that's what I got from OPs post write up.

I can see both sides of the argument, I agree it can be annoying and a bit false but some brands don't allow their products to be discounted other than for approved sales, Boxing Day for example, they must be sold at RRP by all approved retailers at other times, so the alternative is they say "We're having a sale on…." and then list 80%+ of their stock which no one is going to read or if they did would be just as annoying to go through to see if the thing you want is included.

    • Indeed, I can understand it from both the shop's point of view and also that of the consumer's. But imo it's one thing to say "sitewide sale - excludes all Apply iphones", and another to say "sitewide sale - excludes all Apple, Sony, Samsung, Hisense, Dyson and LG products". I think there comes a point where you can't really say it's "sitewide" anymore.
