Legalities of Laneway Parking

Hi y’all!

I live in the last house at the end of a laneway that is unused. I was just curious to know if I would be allowed to park there legally since I don’t have a garage and I’m not blocking access to anyone.

Wouldn’t want to park it then find out that it’s been towed 😅

    Are there any parking signs? If not, and you are not blocking access for anyone (including yourself), then have at it. (You cannot park across your own driveway, even if you live there and own the property and the only access you need is for your own car, it's still illegal to even block access to your own driveway.)

    Other things you may need to consider is how wide the laneway is and any markings on the road.

    If in doubt, ring the council. If they say it is ok to park your car there, get it in writing… and I can 100% tell you now, that there will be one neighbor who will be pissed off at this for no other reason than "but no one parks there is an unwritten agreement we all have…"

      There don't need to be signs for it to be illegal.

        Quite well aware of your point… Hence my "ring your council" remark.

    • Nope no parking signs. The lane is only big enough for one car (if that) to fit through. Theres only one entrance to the lane and on my end it’s a dead end so no one would ever need to get past

      • id be asking council to make it no parking, to avoid being blocked in.

        Also, cant block traffic.

    It may not get towed, but one day you might find it missing a side mirror. Especially if garbage trucks etc come through the area.

    In addition to the points above you need to make sure that vehicles to other properties don’t use that space to reverse into in order to exit the laneway facing forward.

  • Apparently if there is not enough room for cars to easily get past then you might get fined. At least it happened to me once when I parked in a narrow road. No signs saying you couldn't park there, but I was unsuccessful with a parking ticket dispute because I was "blocking traffic". There was enough room for cars to get past and I'd parked there many times before, but :shrugs: Whatever, ymmv, but councils seem to have enough vague regulations to ticket you regardless of where you park if they feel like it.

    Its not legal, but you might not be fined as well as i don't think parking inspector could be bothered with this as long as neighbors don't complain. however it would be an issue if you ever needed emergency services to access your house.

  • Are you saying the laneway ends at your house and you can’t drive through? Do other vehicles park in the laneway?

    My guess is that no one will care as long as you aren’t impeding ANY access or turning space for anyone else. Expecting someone to change where they turn around is a recipe for a council complaint. Making it harder to pass by, or even walk/cycle through is a recipe for problems.

    Unless it states no parking along the laneway you should be OK.

    A while back I went to a house to pick up an item. It backed into a laneway so I pulled over into an area behind a house next door so other cars could pass by easily. Was there for max 5min and someone from the house yelled out “you can’t park there” as I returned to the car to load the items. The car had windows open and 2 people sitting in it, so obviously wasn’t ‘parked’.

    Lesson: it will take less than 5min for someone to complain if you inconvenience them in the slightest.

    • That’s right, there’s only one house that would be blocked but they don’t even have access to the lane at all

        impeding traffic. and yes, i know that traffic could only be you.

        I wouldnt do it, it may encourage others
