Rope Swings on Public Land

There are some great trees for rope swings in some nearby, council managed, public open space.

Could anyone hold me or the council liable if a rope swing I put up breaks and injures someone?

Would the local council remove the swing?

Could the local council penalise me?

I'm thinking:
an injuree is only likely to seek damages for permanent disability or death.
Only when someone complains or takes it down themselves.
They probably wouldn't, but maybe they are able?

      If you are planning to do it I would suggest not mentioning anything to council that could link you to it.

        ^^^This. Do NOT tell the council. If they wouldn't have allowed it, they'll pull it down. If they would have, its there, and you can't be blamed if anything goes wrong.

    On council land they would be liable for any injury etc and get hit with an insurance claim.
    They would remove it as soon as they became aware of it.

    About six months ago, Cottesloe council (here in WA) voted to institute a $300 fee + $100 annual inspection fee for people installing play equipment on council land (in particular verges).

    I don't know if it's actually happened.

    The basic issue is that the council has to ensure that its land is safe, and if some doofus throws up something unsafe, and a neighbourhood kid gets injured, then the council would be liable.

    I have observed that in ACT they cut some down but leave other's for a decade…

    I have Council experience….

    It'll get removed as it's risk that someone gets hurt or a Karen will complain. Don't do it.

    Robe swings are great! Of course, do some due diligence (i.e. look at the rope) and there is some level of risk, but we don't want everything in life to be "safe" do we?

    Definitely consult with the council first whether or not you can put up your sex swing.

  • Nope. Only a qualified Arborist/treesmith could know how strong a tree truly is.

      Failing that, slapping the tree trunk after rope has been secured and loudly declaring ‘yep, she ain’t goin’ anywhere’ is just as good surely /s

    Just take it with you every time you want to go.

    • Not a bad idea. It'd be too tall to completely remove every time but I could make the bottom half detachable.

    But how would they know it was you?

    Tbh if you're asking the question " can I be held liable if someone dies or breaks their spine" then maybe this isn't the best idea

  • council don't even like you to put a a slack line that only you and your group are using and removing when finished, so doubt they would like a rope being left unattended.
    I am not sure how they get away with having the exercise machine things on council land, because I have seen people using them in ways that could definitely lead to injury
    anyway they wanted me to prove that had public liability insurance if i was going to use it in the park.
