    David S: I'm disappointed with this Movie.

    It started off with the potential of a skip-tracing storyline, yet no big-name actors were ever cast, there isn't much of a plot or storyline development or even any soundtrack. It has elements of "The Traitors" but never really makes a case.
    I'd give it half a star.

      …I know David that you don't like the Post and Ghost genre, but here we have a writer that has posted their first thread and look at the reaction it has garnered. I think it is just brilliant the way they have introduced the topic and let the audience make up their own interpretations of the action and characters. Moved right away from a conventional Hollywood resolution to a more nuanced mystery noir. I was absolutely thrilled. I give it 5 stars.

  • You're debating whether to likely spend tens of thousands trying to track down someone that may not be able to pay and will likely go to jail and you get $0 of the 30k in damages + Have to pay PI costs + Court costs + Overall time + fuel + energy on the entire process?

    Seems like you should have opted in for Landlord Insurance, perhaps next time you won't be so cheap to overlook something like that for an expensive investment, $100-$200 a month to cover a 6 digit (or 7 digit) investment is a no brainer especially when you understand that not everyone will treat your investment with respect.

    The best course of action is to let the police do their job and hope she's stupid enough to try and leave the country, or gets pulled over by police (etc)

    Could just be me and perhaps I'm overlooking something here, but that doesn't sound right… you have filed a police report, I assume police have conducted an investigation and have enough to charge her and arrest her, they know her location but haven't done anything about it? You're leaving something out

    I once went through the process of civil court…
    Ex partner tried to sue me after breakup following some crazy friends advice. She was after $10k for "gifts" through a 4 year relationship (shirts, perfume, etc.). Unfortunately for her, I was effectively the provider (covering her rent, bonds, partner visa (red flag now, I know!) bought her a new car, and some gifts). Anyway, I made the decision to counter sue when her lawyer began calling.
    They argued a few weeks, I did a lot of legal research, I put together a few spreadsheets, gathered receipts and bank statements, representing myself when she had representatives for her. They made the decision to drop their case, but we were already 6 months into it. I realised I was at $90k, and she was still clutching to gifts (which I offered to return, but she pushed for cost of items rather than items themselves).
    I pushed on, it lasted three years after the relationship, she must have used up about 6 lawyers, all giving up on her case (getting responses like "we are no longer representing x". I managed to find her living at one of her friends' houses through mutual contacts, so served notice. We had a court day, court ruled $40k towards me payable by her.
    I had concerns she would leave country so requested interlocutory injunction to prevent her doing so until debt was paid. Court said it wouldnt be necessary as they were certain she wouldn't leave country… About a month later went to follow up with court documents to seek payment, turns out she left the country. Courts advised unfortunately its outside their jurisdiction, absolutely nothing they can do.

    Suggestion is to just move on. Money is gone, expensive lesson learned, go forward with insurance. Unless you really don't value your own time, and willing to drop some more money to learn a second expensive lesson. Courts have very little, to no authority. Ultimately it's up to the defendant to have willingness to pay, if you get so far as to have a court order in place, its more a tactic for the honest people in the world to make them more willing. They could still refuse and courts are powerless. Garnishing funds etc is not possible, as they can easily claim they need money to live. They could offer a repayment over 30 years as compensation, and stop short of the first payment.

    TLDR; luckily all self represented, and I had a strong case against her. Cost me probably $1000 in fees for lodging documents, evidence, serving etc. And about a week off work three years of my life. Probably cost her a bomb in legal fees for all the lawyers I demolished. In the end, I saw $0 profit, and only gained a lost faith in our legal system. BUT, valuable life experience, and now have an excellent understanding of our courts. Which suck. But I'm much more confident in my own rights.

    COST: ~$1000 + 3 years of life.
    PROFIT: ~$0

      and is there some sort of alert or something if she ever comes back to australia? ie a warrant or writ or something, since there's 40k owing?
      it would be nice to know if she's been black listed or something… not being able to live in Australia again is a nice penalty for her no?

      • I did pursue this, but unless the other party has had criminal proceedings against them. Theres little that can be done.
        After 7 years, officially, even a court approved debt cannot be enforced. So if you can hop countries frequently, theres good money to be made!

        Civil matters are all effectively similar. Theres got to be proof, an address to serve, most definitely a lengthy process, and then an outcome.
        In the outcome there then has to be a willingness for the other party to pay, and unfortunately there is countless ways for them not to.
        A cautionary tale to OP. PI or not. Court notices or not. The money isn't coming back.
