Anyone Had a Good Experience with a Work Place Lawyer?

Ill try and keep this brief, looking for legal representation to take on a reoccurring error/ failure by a public employer. Constant apologies, but the issues have effected my pay negatively now for 4+ years, and im still waiting on correct payG slips for all these years (ATO have issued me a fine for failing to lodge, indexed daily).
So basically want / need it be escalated into the hands of someone who knows how to fix it once and for all.
I am part of a union, but wish I never took their legal advice (which was ultimately a waste of time, as they settled out of court, but the settlement terms were never fulfiled), and it all just happened again. Should have persisted and set a legal precedent so no one else has to go through this.
Keeping it vague, just in case.

Id also like to know who to avoid. Dont type it here, as OZb have already had defamation type grief from some dodgey firm. Send me a PM.

    Have you actually talked to the ATO about this?

    • yeah, they are trying to get it sorted as well. But they change agents every 5 seconds. Got a third person on it now. Mentioned it may be removed once everything is lodged…hopefully commonsense prevails!

    • Yeah, I want to go to the media. Union says don't do it…but it's getting to the point I dont see any other option (other than legal). Dont want to jeopardise that with media involvement.

    Umm reminds me back at least 30 years ago when disputes with wages with employers was handled by government agency called wageline, I'm sure was a federal government agency

    Long story short working for a pizza shop in Sunshine, Melbourne called "God Fathers" funny getting paid a wage not per pizza delivery which was un-heard of, anyway obviously wasnt get paid correctly under what ever award back then, well used wageline in them days to chase lost wages but this was settled outside of wageline by the person who took the case with the owner of God Fathers for a cash settlement which im sure the wageline agent had pocketed some cash off the owner of God Fathers, wasn't complaining got $2k cash and only worked for God Fathers for 9 months, mind you this was $2k cash in early 90s

    Was one of my most favourite jobs, well getting paid to race in somebody elses car, those were the days

  • For wage disputes you talk to Fairwork. For tax and Super you talk to ATO.

    Couldn't you go back to your union and get them to take it to court?

    • Not all unions are competent

    • You would think so..but I think they have realised they have also stuffed up and may implicate themselves. Really disappointed in the union. Some terrible advice given (I already knew the outcome of one issue, and they advised to do the opposite with some doomsday warning. Was terrible advice and not sure if they are even qualified/ trained in what they say they are). But no one wants to be told they are wrong, so left it, but I now know they are incompetent.

  • What are you looking to achieve in court? Backpay for yourself or penalties applied to the employer?

    Why did your union settle? Is it an area of the law that is in the too hard basket?

    How much are you willing to pay? Only no win no fee places or are you ok being left with a bill?

    • Just after my FTE salary paid during the time they have stuffed up, plus all other cost incurred following up their mistakes. Also some damages payable, as it has definitely had an impact on my health (have this documented already with a medical professional documenting 100% fault of the employer). Looks like we are going nowhere in the future, so lost future income/ severance payout or similar. Plus accrued leave paid out.

      They said they settled, because "it's the way they have always done it". I really don't know why they aren't going back to court again, maybe a conflict of interest there somewhere. Doesn't make sense. Maybe just incompetent.

      As for willing to pay, I have no idea of the costs. The Union legal fees were around $3k. I have my house for sale, so was hoping $10k from the proceeds might get me somewhere. But I'm just a public employee, so don't have a vast income. But, very sure it's a no brainer case. The level of repeated mistakes/ incompetence is farcical.

      As for no win / no fee. Pretty sure there is no such thing. Always clerical fees etc .

    I did date a nice workplace lawyer a while ago. She was nice but we had different life goals.
