Samsung Asking for Trade-in Phone Over a Year Later

Me thinking i'm a ca$h money genius, bought a Samsung S21+ while they were offering the additional discount when you trade-in deal. Got my new phone and had my old trade-in ready for a sending but nothing from Samsung. Months go past and I completely forget about the trade-in.

I eventually send my old phone into that random phone recycling place that send you not the good kind of bags in the mail, empty, to send back with old phones.

I received an email from Asurion (they deal with the trade-in side for Samsung?) today, 1y 3m later, saying the below:

"Whoops! Looks like you completed a Samsung Trade-Up order, but we didn't send you the eParcel to return your original traded-in device! We apologise for this error."

They are saying i need to post the phone within the next 7 days or they're going to break my legs. Obviously the old phone is goneskies so i can't send back but also not keen at all to have to pay $200 because i don't have it anymore.

Is this reasonable / anyone else get this?

      Sure, I also agreed to return my device within 7 days of receiving my new Samsung device using the pre-paid digital return label provided. Or is failing to send an automated email outside of their reasonable control?

      Not saying i didn't agree to it, i'm asking is there a reasonably practicable time frame on agreements for this or if anyone has had any luck on it. Will have a look through the old posts, thanks.

    • Hahah true, I did this. But now they charge like a $50 or more admin fee on top now based on future posts of people saying they got it without trading it in.

    I would just say 'sorry, due to the extended and unreasonable delay in you providing xxx, the phone has now been recycled instead.'

    • Thanks for the advice mate, have sent this off similar asking for a confirmation that my card will not be charged and no further action from myself is required.

        I did this after I sent back a phone under samsung care. It disappeared in the mail, they wanted to charge me full price despite evidence that I had posted it. After 6 weeks they finally recieved the phone (my suspicion is it got knocked off by postal worker, then reappeared after I took up a claim with auspost).

        They sure as shit weren't charging me RRP for a broken phone that took 6 weeks via post, so i just got a new card number.

  • I don't understand. You've chosen to not send anything to Samsung but then go out of your way to recycle the phone anyway to another company.

    • Bit hard to send something without an address.

      Was running out of storage in my old phone walk in wardrobe so had to make some culls.

    their problem, not yours. lock the card and get a new one

    • Then they could put bad credit ratings under your name.

      • I don't think they can if the amount if less than $1000. Although, they can easily bump up $200 with exorbitant fees and charges.

        • Where do you find that magic number of $1000? Or $200?

    Seems pretty unreasonable, if they did not hold their part of the deal by sending you a eparcel to return the device, then that's on them, not only do they have to send you the parcel in a timely manner, there is a limit to how long they can expect you to return the item, i would say 3-6 months is reasonable, 15 months is not.

    Tell them you sent the phone in to get recycled after not hearing from them, and of course that it is no your responsibility but theirs that they never received it.

    Why don't you sent an email to them and explain them the situation. Tell them that the onus was on them to send the return satchel with 7 days and it is unreasonable for them to request it after a long time. If they don't agree lodge a dispute with the Telco ombudsman (only if the phone was from a telco) or report to your state fair trading department.
    You can also send them an invoice for storing their goods for one year, and the costs of disposal.

    While they may have the legal right to your old phone, its really unreasonable for them to be so disorganised and request the phone after over a year later. I was on the same boat, contacted them twice within the first three months to get the label to return the phone, they just dont care. And after a bit less than a year, i too received the same email.
    This is so bad it almost feels like a scam, as it is your responsibility to keep the phone in working order while you are waiting for their negligence. If your old phone breaks during that period and Asurion decides that its is not fit for the trade in program, it will be the customers responsibility to prove it was in working order. All asurion have to do is to have their affairs together and send out the lable within 7 working days as agreed.
    Interestingly, it seems business can dispose of a uncollected goods if the owner does not collect the goods within 6 months. Not sure why customers does not have the same right.

    Email them back saying

    1. The unreasonable turnaround time of the return satchel incurred storage costs for the phone, starting 30 days after the transaction

    2. drop in a calculation like this:

    (Duration of storage x fair weekly storage charge) - trade in value = Total amount they owe you

    Eg
    (60 x $5) - $200 = $100

    1. Provide them an invoice for the outstanding amount they owe you

    Just ignore them, cancel the card or use a virtual one next time and move on. I’ve done this twice for my old s21 ultra got $400 off and obviously didn’t send the phone back I sold it on face book and yeah I got a couple emails just delete and don’t lose any sleep at night about it

    Quick update…

    I received the same email and replied to the email address provided stating that I no longer have the phone as I had to send it to our local tip due to swelling battery, which was a safety hazard.

    Their response:

    "Thank you for reaching out to us and apologies on the inconvenience caused to you. Given that you are no longer in possession of the device due to the delay, please rest assured that no charges will be placed in relation to Trade-id: SAxxxxx. Kindly ignore any further emails you received for this Trade-in ID."

      I sent off a similar email (replace X reason with Y) and got a generic response below:

      "As part of your Samsung Trade-Up order, you are required to return your original trade-in device to us. If we do not receive the original device within specified time frame, you will be charged a Device Non-Return Fee."

      I Asked for it to be escalated and they said they've passed it onto a case manager, didn't sound like they even read the email.
