Clipped Another Car on The Road

Hi guys, I clipped another car on the road recently. My fault. Just want to hear your thoughts if it's better to make a claim through insurance as third party property damage or just pay the other driver's costs myself ?

Looks like just a scratch on the duco of their car. My excess is about $700

Anything to consider ?

cheers

It all depends on the repair cost? You can ask the other driver to get a quote for the repair and pay him/her directly if it's under $700?

If you do decide to pay the driver out of your own pocket, make sure you get them to sign an agreement releasing you from any further liability for the incident. (Wouldn't want them coming back later to try and claim more after you've already paid them).

If the final amount ends up being a little over $700 (for example $1000), I'd still consider paying them directly because an at-fault claim is likely to increase your premiums for the next few years anyway.

Sensible post with sensible advice given in return.

My popcorn stocks will never forgive you.

    • thanks for the reply. Do I have a 'deadline' to tell their insurer if I'm going to go thru my insurer or pay out of pocket ?

      • There's no specific time limit, but most insurers would prefer you notify them asap. Having said that, the normal process (if you don't have any damage on your car that needs to be repaired) would be to wait until the other party sends you a letter of demand, then forward that letter to your insurer (if you're not paying it yourself), pay the applicable excess and let them take care of the rest.

a very un-ozB forum thread relating to car accidents

usually….smashed into a ferrari, no 3rd party, have already admitted fault, also ran over 3 small children during the incident - what are my rights?

        Also

I need compensation for the stress this has caused me and my mother in law.

          Also

Does anyone know what's within my rights under ACL to get the car refunded? Calling ACCC tomorrow.

Just apply common sense. You're doing great so far. We believe in you.

    Needs a pic
But you're allowed to let them get a quote and then make your assessment based on that.

I guess it might depend on what the other driver wants too. If they put it through their insurance - which they're well within their rights to do - you may find dealing with it becomes a lot more difficult.

  • claim on your insurance. it might be more than $700 as the other party is entitled to hire a car for the duration of repair.

    • -2

Not necessarily. Other party is entitled to a hire car only if their are in not usable. small scratch does not make the car unsable.

      • as the other party is entitled to hire a car for the duration of repair.

    1. Ask them to get a quote for the repairs.
    2. Make a decision on using your insurance based on the quote.
    3. If they are going through insurance double check with their insurer the price of the repair. Make a decision based on $.

Is your insurance comprehensive or have you purchased third party property separate to what is required by registration? You’re wording makes me wonder if you are thinking of claiming on your third party compulsory, which you cannot do. Third party compulsory is for injury to persons, not property.
