Mobile phone has died but still have 6 months on contract with Virgin - options?

My Samsung Wave's screen has died but I still have 6 months of a 24 month contract with Virgin, they won't replace the phone as it only has a 12 month warranty. I don't want to upgrade to a new (more expensive) plan - what options do I have?

    Your consumer rights are not limited to a set time period. Instead, they apply for the amount of time that is reasonable to expect given the cost and quality of the item.

    It may be reasonable to expect that a phone supplied on a two-year contract should remain free of defects for that period

  • Phone was bought in Dec 2010 - can't find the link on the ACCC website to pre Jan 11 purchases!

  • Try your luck with TIO but unlikely
    Buy a new phone outright

    • Buy a Cheapie like the Huawei X3 (or similar), available at Woolies for $50.
      It'll be locked to the Optus network, but that's fine for you.

  • Yes, can confirm phones locked to Optus network will work with a Virgin Sim. Goodluck.

  • I'd recommend asking the onbudsman what the situation is here . I think you'll find they have a liability to provide you with a working phone for the life of your contract (excluding damage you have caused to it of course). At worst it will have cost you the price of a phone call, and you may avoid having to fork out for a new phone just yet.

  • Try to renew your plan on he same value contract then? Sometimes they would waive the remaining months off your contract
