Annual Leave Accrual Payout

So long story short I was approached by a recruiter and have received an offer for 10k more than my current pay.

I have not passed the probation period (currently in my fourth month) and after reading my contract I am not sure if I will receive the annual leave I have accrued (45 hours ish).

Is the default in Australia that you get your leave entitlements despite not passing probationary period? I am young so please don't be mean.

    Employees who resign during their probation period are still required to give the amount of notice required in their employment contract, applicable award or registered agreement.

        The Australian Services Union covers IT staff regardless of employer. Should join.

          This, plus OP's question is likely clearly spelled out in his employment contract. If it's fixed term they generally have a special clause dealing with entitlements if the employee jumps ship early.

    • I'll save you the time and money of finding an answer from some comrades at a Union: yes you are required to be paid your annual leave upon your employment ending. Probation period makes no difference.

    If you have only worked 4 months, you can't have racked up 45 hours of annual leave. You might want to check again.

    But by law they have to pay you all leave entitlements owing to you (not sick leave)

      I'm a full-time employee, I accrue ~12 hours of annual leave per month at my work.. That works out to be ~48 hours in 4 months. So yes, it is absolutely possible.

        • weird, im on salary weekly earn 2.9231 hours AL a week, so 2.9231 x 13 weeks(4months) = 38 hours
