Company Car Speeding Infringement - Points or Pay?

Our small business (in NSW), has a vehicle registered under a company name.

We received speeding fine (8km over in a 40 zone) in ACT for $1,265.

I can either pay this or nominate the driver (me).

I'm guessing the fine will reduce to around $300-400 and I'd get 1 point.

I've got 3 points already and the question is whether adding more points will affect my insurance (over the next 3 years), and if it does, I may as well just pay the higher fine.

Has anyone done the maths on this?

Depends how much that point means to you. Is it worth $950?

If the car is through the business do you declare your traffic offenses? I don't think you would. Might be worth checking with your insurer.

  • If the company cops the fine, then is it tax deductible?

      Fines are never tax deductible

isnt it if you are the driver of a company car the fine is 3 or 4 times as much as the fine would be if it is not a company car but your own?

It should be law that the company gets shut down unless they nominate someone. Ridiculous that the wealthy can get away with paying off the fine on something that is one of the top killers in Australia.

Huh? How many people do you think die in car crashes? How many people die from cancer? Heart disease?

Time to “shut down” everywhere obese people buy junk food…

Ok I concede on car deaths not top killer. Do you also disagree that Elon Musk can be allowed to speed and never lose his licence by paying the fine through his company?

Elon is a god amongst men … he's fathered more children than I can count on my hands … pretty sure he can do whatever he like.

Some states will have a maximum number of fines without nominating a driver before they come down on you like a tonne of bricks. https://www.transport.nsw.gov.au/news-and-events/media-relea…

    • I don't see any jail time proposed but the seizure of potential lambos is a good start. I wish it was mandatory though. It seems like police could look the other way.

I will personally nominate personal for the much lower fines.

  • Having a speeding fine might impact your own car insurance. Whether it is $950 worth over the resulting renewals up to u to figure out.

Previously, all insurers used to ask how many 'moving' offences to assess risk when applying for insurance. Over the years, most seem to have removed that particular question because it's way too easy to get a speeding ticket and it's no longer a reliable indicator of risk. The question they now ask is about "suspensions" (which requires a number of offences) that would indicate a 'pattern' rather than an individual fine.

      • Yup, I just recently insured another vehicle and there was no mention of demerit points in the questions I received from AAMI, Budget nor RAC. The questions were only of I'd had a restricted license or lost my license in the last 3 years, claimed insurance, etc, etc.

Also asked if I had a criminal record… do convicted criminals drive worse than your average joe? ¯_(ツ)_/¯

They generally refuse to insure anyone who's been convicted of any criminal offences that involve elements of 'dishonesty', such as fraud or stealing. That's a normal thing with all insurances.

Google car insurance and demerit points lists this as one of a few relevant answers - https://www.aami.com.au/aami-informed/on-the-road/insuring-a…
