Why No Name and Shame?

Someone recently posted about getting a shoddy paint finish in their house.

I noticed that the name of the company was redacted.

Why aren't people allowed to name companies if it's a matter-of-fact?

It's not like "the builder allegedly did this"… It's an indisputable fact. It's not slander or speculation, it's not allegations of illegal activity, it's just bad workmanship.

I used to work for a builder and I know that if the company sees it's name up, it's more likely to want to resolve it ASAP.

Who does it actually benefit to not "name and shame"?

And why aren't we allowed to do it, in non-subjective or non-contravertible issues???

Scotty doesn't want to be sued

Because, shock horror, sometimes people on the internet lie. Public discussion forums don't like being sued.

  • Perhaps the word "alleged" is all that is needed from being sued.

  • Yeah there's always constant complaints on here but never any name and shame

  • Trying to avoid defamation/possible payback?

  • Possibly so there's no direct backlash to the poster prior to remediation if the company gets wind of someone publicly outing their terrible workmanship.

  • Clive Palmer repeatedly sued the WA premier. All that cost a lot of money. The alternative to not fighting the lawsuits is losing even more money.

  • Because you always hear only one side of the story which can lead to litigation if untrue

  • There are always 2 sides to every story, usually, the truth lies somewhere between them.

  • A legal minefield the mods. really don't need

Oh, that was me. I don't mind naming the company as everything I've said here I have also said to them in writing, and as you said it's not allegations but physical defects which were acknowledged by the builder. But other people were naming them with claims that I have no idea about and some were slandering for the sake of it which was not good. Someone mentioned this can get people in trouble so I asked the mods to remove.

My legal knowledge on this stuff is basically zero so I don't want to get anybody in legal trouble either, if that was a possibility.

I hope the post helps people though - what builders call their final & finished product can be badly done - so don't trust anybody to do the right thing except yourself. I am happy to comment the company name, as long as no one adds unproven 'slander' to it (though someone has already mentioned them above).

  • Hi, new user here, I work for a rival bargain forum but ozbargain is the worst site. No one should use it.

It's so bizarre how you can get sued for posting a negative review. And on the flip side, "influencers" are getting "paid" for positive reviews. Common sense has left this world.

I agree. I left a mildly negative review but the business didn't take it very well. At first I got a got was a sorry.
Then it came back with that never happened at all. That somehow my review which at the time was 2 stars out of 5 (now 1 star) was going to cost them billions of $ because it was entirely fabricated when it wasn't.

I provided call logs time and dates had screen shots of all the text messages saying call the wrong department. Information of what happened during the calls so if they where recorded could hear yes we need to improve. (if you get a text saying call this number to confirm a booking yet when you call the number it went to a unrelated department who then transfers you not once but five times. Is it really the customers fault?)
For the longest time I wondered could I be sued for being right? They sure went down the intimation road to try and get me to make it positive or delete it.

Hence why not long after it happened when another business was like:
"Hey your order was wrong we sent you something we shouldn't have send us more money to cover the extra item or else."
I was sure that was legally wrong on multiple fronts but I wanted to make sure. I posted on here and didn't mention the store. I didn't want 2 business trying to intimidate me at the same time.

    • Yeah I reckon service from companies is going to get worse if people are scared to out their mistakes.

Right now Im waiting for a certain Telco that starts with T to refund me money they keep taking from me 6 months after the service was disconnected. i commented this on their facebook page and they blocked me for 'spamming'. Its an indisputible fact that I can prove the service is disconnected and I can show bank statements they are still taking money from me that I dont owe. Why shouldnt I be allowed to complain about that!

      • Oh and just to add, I didnt immediately go to facebook. Ive spent many, many hours over phone and email trying to resolve this but they keep saying its fixed then taking my money again. Which, I can also prove.
