Australian Consumer Law for No Name Air Fryer Purchased June 2020 $100

Hi all,

My no name air fryer broke this week. It was bought off eBay in June 2020 in one of those blink and you miss it deals.
From memory, it was usually $200 but I got it for $100.

It is now outside of the warranty by 6 months. Is it worth asking the retailer if they could help? it's not from a big chain so I'd imagine they are unlikely to wear the cost.

I read this forum topic The Australian Consumer Law with Regards to Warranties.

So I guess the question is what cost/price do you involve ACL?

Emailed KG electronics and they are replacing it.

    No name… $100…. Sounds like quality, I'd be jumping up and down waving my fist in the air - without doubt.

  • What is the retailer? If they have a bricks and mortar presence could be worth rocking up with the broken air fryer during a busy period and asking for a manager and refund.

      Great air fryer, Nil issues.
      My theory was that there were too many things running at the same time.

      • Have you approached the retailer with what you'd like as an outcome regarding this issue?

        What is boils down to is this; Did you expect the air fryer to last more than 18months? If so, then approach the retailer to discuss how they may be able to assis you.

        Keep in-mind that you are not entitled to receive a refund.

        How do you think this caused your device to fail?

  • did you purchase with a credit card (CC)? sometimes the CC company is easier to deal with.

    • Yes but i bought it on one of those churn and burn cards.
      Lesson learnt!

    18 months of constant use for a no name, high power consumption product worth $100 type of appliance I’d be cheering/impressed tbh.

    Up to u though, there are other members who have tried to flex ACL for less.

    Have you contacted manufacturer?
    I've had things replaced up to 12 months outside warranty just by asking.

    Biggest problem with no-name brand is that they probably don't have customer service.

    You have nothing to lose by asking…

      Not yet. I thought i'll do the ozbargain way and post on a forum first.

    For ebay my go to strategy is to leave negative feedback then contact seller

    Seems to increase chances of a refund

  • Yeah I think this one is on the edge but you are probably still within your rights to request a refund, replacement, or repair as the thing breaking is clearly a major fault.

    The main argument would be what is a reasonable time to expect the product to last. I'm not sure if the ACCC has issued any guidance in regards to Air Fryers I know they have stated suggested lifetimes for TVs and some appliances.

    So while you may be entitled according to our very strong consumer laws I doubt the company will happily refund you unless you are willing to plead your case and go to the relevant state business obudsmen and make a formal complaint.

  • Question is why got sucked into those noname overinflated price ebay crap when you can get one from kmart or the like for less than that and at least 2 year warranty. For a kitchen appliance I (and ACL) don't think 1 year warranty gonna cut
