New Case Sent The Wrong Item and Will Not Exchange for Correct Item without Me Paying Return Costs

I purchased a USB charger from New Case, carefully selecting the one I wanted as the orientation of the power point pins was important to me. My power point is very close to the floor, so went with NewCase as their photo showed how I wanted it. I did not receive the one I ordered, the one I received will not fit as pins are 180 degrees opposite.

I'll give an example to explain the problem.

Lets say I have a very small garage so I research a suitable car, I'll go with a good Aussie brand, a Ford Festiva. I agree to pay the asking price that includes delivery. The car is a good fit for my garage so go with it, as anything bigger will not fit.

On the day the car arrives it's a Ford F150, way too big to fit in the garage, will not fit no matter what.

I approach the seller and they say I have to pay return cost if I want a refund. We discuss via email where I offer various ways where I can receive what I ordered and they keep the sale, No Go.

I'm aware of the ACL although it is vague on return costs, surely when the product is wrongly advertised they are responsible.

Should I have to pay return or not?

    I had a look on their website and found this:

    If the return is the result of our error we will post the correct item for free and the customer may not be required to return the item depending on the value. The customer must provide photographic evidence of the incorrect item being sent. For items of high value we will be responsible for return shipping.

    It sounds like they should send the charger you ordered, but you might need to return the incorrect charger. I'd like to personally think you wouldn't need to return something so cheap and it was them who mistakenly sent you the wrong charger.

      For OP's situation, I interpret their policy as:

      If the return is the result of our error we will post the correct item for free

      They will send you the correct charger at their expense.

      and the customer may not be required to return the item depending on the value.

      OP hasn't linked the charger, but if it is below the line on their 'low value/high value' threshold (assuming it's in the realms of $15-20) then OP is not required to return it. Makes sense as return costs are probably materially similar to item value.

      Newcase don't seem to be challenging that they sent the wrong thing, according to OP, so this seems fine

      Their policy is that if the item is above the low value/high value threshold, they'll pay for it to be returned so they can sell it again to make money.

      Of course Nicecase may choose to be difficult, but I feel that is a fair interpretation of their policy. Nowhere does it say you would ever pay return shipping - just that you get to keep it if it's cheap, or they'll pay for the return if it's expensive. Perhaps there is a middle price band, but it isn't explicitly mentioned.

      However on a separate note without being linked to the item, it's hard to tell. Perhaps it is a Chinese plug vs an AU one and the error sits with the OP rather than Nicecase. That could be a reason for them to request return shipping as they see it as a change of mind/purchaser's error rather than their error.

    Ford is American.
    Festiva was manufactured in South Korea and, especially the second generation, were some of the worst cars ever built and to grace our shores.

      And weirdly enough, if most people got an F150 over a Festiva, most would keep the F150.

    Chinese plug is ours upside down. photo will show in plugged into Chinese outlet. So in Aus it will mount 180 degrees different - like you found.
