Samsung Phone - Any Issues if Second Hand and No Receipt?

Hi all, if I buy a second hand Samsung phone from marketplace, would I have any issue if there's no receipt (under contract)? Still got 1.5 years to go.

Would Samsung just go by manufacturing date?

  • Legally, warranty is not transferable. It is only applicable to the original owner.

    You could try going to manufacturer and they may be happy enough to use manufacturing date - keep in mind; the item could be manufactured a long time before it was initially sold. Also, they are also perfectly within their rights to say no to any warranty claim without proof of purchase.

      Note that regardless of whatever Samsung says, Australian consumer law over-rides that.

      In this case, yes - warranty is completely transferred for an object and you do have rights to repair/remedy if the product is faulty (within a reasonable timeframe of when the item was made).

        I dont think that is right. The OP has not been clear on whether they are buying from a business or an individual on Marketplace. Assuming an individual, "Australian Consumer Law does not apply when you buy from a private seller (eg buying a second-hand item from an individual on eBay) because they are not acting in trade or commerce like a normal retailer.

        When you buy from a private seller, it is called a consumer-to consumer transaction and contract law applies. However, you still have the right to expect the title on the goods (full ownership) after purchase and that it is free from any security or charge on it, unless told otherwise before the sale."

          Samsung will repair phones you buy off gumtree or ebay etc. IF you have the receipt that helps. If not they will just use the manufacturing date.

            @meowsers: Yes and that is due to their goodwill or customer service policy - not due to the Australian Consumer Law.

    pretty sure you'll need a proof of purchase to make any warranty claims with samsung

    I bought 1 year old "refurb" phones from ebay before and claimed Samsung warranty if there is an issue in the remaining year. I have always gone to a Samsung kiosk for support and I don't think they need proof of purchase, I told them that it was a mobile contract phone, therefore no proof of purchase. They can see when the phone was manufactured by the IMEI anyway. I have done it twice successfully so far. YMMV.

    The only thing you need to make sure is that the phone is an Australian model and that it has not been "repaired" previously.
