  • I got the confirmation email so I'll wait and see. Nothing lost except some time waiting on their site so I won't be drowning my sorrow in drink if they don't arrive. Fortunately I was doing other things with the computer.

    • Hmm, looks like they cancelled my order. (I'm in Sydney but not in one of their target suburbs.) Upon logging in I found the case in my shopping cart but at the normal price, so I deleted that. The link provided in the confirmation email for my order didn't go anywhere.

      It was more or less what I expected. I hope they are more careful with their website in future. To ourcellar, you guys aren't the only wine retailer on the web you know. I have bought from one of your competitors and they didn't fumble like this.

    FYI:

    Deal is taken down for now on the request from OurCellar.com.au, as the website has just been ozbargained.

    Seems like we killed their servers. 2799 clicks. OzBargain: Offering free load testing for your servers.

  • Actually somehow the DB survived the frontend resets, because I had two cases in my cart just before my successful checkout, presumably from my two attempts. I was nice and removed one.

  • Cannot login to the site anymore, I assume it's because my account is gone? (Can't reset email cause it doesn't exist either)

  • Got an email from "Paul" from OurCellar.com.au at around 12pm today that OzBargain has been crashing their server. They are happy that they were discovered by the OzBargainers, but Paul reckoned their website is not yet ready. Thus the request to pull the offer down, before their server caught fire I guess.

    Their website is sort of back although still quite slow. I might ask Paul when we can re-post their offer.

    Hi Guys- thank you very much for your interest in our free wine offer. As you are aware our test got hammered yesterday but it has since been moved to a bigger one. Anyway our original plan was to run the offer softly (at least until it got Ozbargained!) into areas of Sydney suburb by suburb.

    Our delivery drivers are systematically delivering specially labelled empty 6 pack boxes to households in their respective delivery areas where the recipients can go online and redeeem their free wine. OurCellar is a new company and apart from being a good way to build our database, the promo is also a test for the website and our delivery system technology.

    As mentioned on the website, we will firstly deliver the free wine offers to residents of the following postcodes 2750, 2747, 2749, 2745, 2033, 2032, 2031, 2287, 2289, 2299, 2305, 2303, 2292, 2291, 2046, 2137, 2138, 2040, 2041, 2039, 2000, 2009, 2040, 2154, 2153, 2768, 2155, 2769, 2039. The promo will be rolled our across firstly Sydney Metro and then into other Australian states as we expand. If you are not in Sydney and have already registered, we will do our best to honour the free wine offer.

    As you can imagine, we have limited stock of free wine to give away so its only while stock lasts and only one 'Free 6 pack of Best Bin Ends Wine' will be delivered per registered customer. By the way, we normally sell Best Bin Ends Wine for $4 each, it's bloody good and will be available for sale through the site from mid March.

    Hi Paul,

    Thanks for the feedback.

    I went through your order process yesterday - after reading the Bold promise on the front page of your website that the offer is "available to Sydney residents" - which to any reasonable person means the city and suburbs of greater Sydney.

    There was no mention in the order process of:

    1. That you only deliver to the suburbs you mention.

    2. That there was any limit on the number of cases one case per order.

    3. That you wold be delivering Empty!!???!!??? boxes.

    Customers ordering so far have not had any of the above information communicated to them either before or during the order process.

    The offer still remains on your site.

    You are gathering personal information with bold promises that you are now stating you are not going to deliver on.

    It is up to you to reprogram your online ordering system to limit numbers of orders and ensure delivery addresses are in the delivery postcodes.

    Its not good enough to issue order confirmation invoices and then tell customers that you are no longer going to deliver.

    Your company has bold promised to deliver to all of Sydney.

    I expect you to honour all existing invoices.

    Otherwise you will open yourself to clear claims to the ACCC and the NSW Department of Fair Trading for misleading and deceptive advertising.

    I have no malice towards any company.

    But when a company makes a bold advertised promise as still seen on www.ourcellar.com.au then it should honour that promise and the entirety of subsequent orders.

    Welcome any feedback from www.ourcellar.com.au and forum participants.

    Thanks for your feedback and yes you made some valid points which we will address. I don't think you fully understand the 'empty' box issue. As I mentioned in my original post. We are in the process of delivering empty 6 pack wine cartons to all Sydney suburbs with instruction printed on them on how to claim the free 6 bottles of wine. When we roll out the next promotion we will be including a promotion code for redemption to make it a bit easier/clearer. In regard to limits, the offer does clearly state '6 bottles of Bin Ends delivered to your door'…

    As I also mentioned, we will be honouring the deal to all customers who registered and we are currently in the process of delivering wine firstly to the postcodes that we have already targeted (our 6 vans are flat out) and the rest will follow soon after. Yes, I agree this offer needs some fine tuning but you have to admit its a pretty good offer - not too many independent retailers out there giving away 6 bottles of wine (I think we're up to 2000+ free 6 packs already)

    Thanks for the reply.

    1. The home page IN BOLD FONT on your website promises Six bottles of bin ends wine delivered free to addresses in Sydney.

    2. Now we hear that you are delivering empty boxes with "instructions" on how to receive the wine.

    3. What do we need to then do? Meet some guy in a trenchcoat walking a Dingo under the Harbour Bridge at the stroke of midnight under a full moon?

    4. Why are these additional steps not disclosed to customers PRIOR TO THEM ENTERING THEIR PERSONAL INFORMATION ON YOUR WEBSITE for heaven knows what purpose.

    This seems to be a bizarre way to run a business.

    As it stands:

    1. You have made a clear offer.

    2. People have responded to your offer and YOUR SYSTEMS have allowed them to order multiple boxes and you have provided them with invoices for those multiple orders.

    Now - without any direct email communication to those customers - you change the goal posts and say we will only deliver empty boxes to people in specific post codes.

    How can any customer have any confidence that ANY ORDER placed via your website will ever be fulfilled under these circumstances?

    As it stands customers can have ZERO confidence that any order ever placed with www.ourcellar.com.au will ever be fulfilled. I'm just thankful that I have not made any payment or provided any credit card details.

    I STRONGLY SUGGEST that you get immediate legal advice from a lawyer specialising in advertising law to sort this mess out.

    In the meantime modify your website to cover off all these problems and clearly communicate the exact nature of your offer with full terms and conditions DISCLOSED CLEARLY UPFRONT to all potential customers.

    Otherwise you are going to end up with many upset customers and potential claims.

    I understand that you are launching a new venture - and only wish you well.

    But please bedrock your business on:

    1. Clear unambiguous, communication with customers.

    2. Honour all bold promises and placed orders in full.

    3. Don't change the ground rules after an order is placed.

    4. Ensure your stock levels and systems can cope with orders.

    I look forward to receiving my order in full.

    I'm not interested in empty boxes.

      Thank you again for your feedback. This promotion was based a delivering a promotional box in selected areas. As I have already explained, the box delivered the message to the customer and how the promotion works. The promotion was a free gift for people helping test our site and delivery systems.

      Unfortunately the promotion spread by unauthorised individuals placing the offer on some sites such as Ozbargains, facebook etc which was not authorised by OurCellar. The reality is we are offering a limited number of cases (2000) delivered in select areas. We will be delivering all orders placed through the greater Sydney Area, Central Coast and Illawarra. Those individuals that have registered and/or placed an order, that are outside this area will be notified when we will be making the offer in their post code and will be on the top of the list for the next promotion so yes you and many other people who have registered like you, will receive a free 6 pack of wine as a thank you for helping us test our systems and for registering.

      • Mmm, if you had wanted a restricted audience, you should have implemented some kind of access control. The history of the Internet is full of leaks of information from people who thought it was sufficient to tell nobody about their sooper secret webpage. It doesn't work that way.

  • OK well bullet point all those points and terms and ensure that everyone ordering the promo on your site can see them as they are ordering.

    That will help eliminate a lot of second guessing and confusion.

    Note the use of Crazy Domains as the registrar. Crazy Domains are one of the few registrars that do not check eligibility for dot com dot au domains.

    There was nothing on the item that stated Sydney only when I added it to my cart.

    You really need to completely delete people from your website if you are not going to honour your offer, ie don't send me any spam if you are not going to honour my purchase.

    And I searched the Liquor License number 24003377 on the Nsw gaming and racing website with no result:

    The website says its a packaged Liquor License … But Theres no reason that it should not be searchable if it is a valid number. ??

    The Contact us page features a phone number and email address but no business address, ABN NUMBER, ACN Number ….. Or more importantly …. The actual name of the liquor licensee.

    Look at the front door of any licensed premises in SYDNEY and you will see the name of the licensee.

    This is a legal requirement.

    This company is home delivering alcohol … I'm pretty sure such information should by law be communicated to all customers.

    Also the invoices had no company details other than the logo.

    A series of interesting observations.

    However … I could be wrong … Another well known liquor retailer … For example … Just has address, company name and contact details ….

    I think Nsw liquor and gaming would be very interested in such a situation. ….

    Geez give it up already. You weren't meant to get the offer. If you keep crying maybe soon you will have enough tears for 6 bottles. Sometimes you just miss out. You have provided the feedback and it sounds like they will take it on board. Time to move on.
