Advice on Grey/Parallel Import Nail Gun That I Purchased on eBay

Hi,

I recently bought a nail gun from eBay. The seller was an online tool supplier based on the Gold Coast, QLD.

The nail gun that I needed had specific requirements; it could handle two different gauge nails. The Australian manufacturer's website specifies a particular model that can do this. The item that I purchased from the eBay store matched this model number exactly.

The problem is that the nail gun I received is a US import and even though it does have the same model number, the feature is not on the US version.

The seller did not claim that it could handle both sizes, but the listing and website doesn't state that it was an import, so I assumed that the information on the manufacturer's website would be the most accurate.

The seller will offer a refund but I will have to pay to ship back and also reimburse their original shipping cost.

I would like to get some other opinions on this as I can honestly see both sides to this problem.

    Tricky, you assumed that the manufacturer's website was accurate for the item you purchased so you can't blame the seller.

    Personally, I believe you'll have to wear it and pay to ship the item back if you want a refund.

    At least you are honest, a scammer would put in an INAD claim, get refunded, and be allowed to keep the item as well.

      Thanks for your feedback. I think I'm just frustrated that the seller didn't state that it was an import.

    Unfortunately, the vast majority of the stuff for sale on eBay nowadays is either a counterfeit product or a dropshipped Import.

    • I do agree. Normally, it's probably not an issue except in this case there is a major feature difference.

    If you paid with Paypal you "may" be able to use their "Refunded Returns" system to recover the return shipping costs…

    • I used Afterpay as there was a voucher code associated. Not sure if they have a similar policy. I'll have to look into it.

  • The seller should have declared it was a US import in the listing and stated overseas models may vary. open an item received not as described request via eBay.

    • Seller probably wasn’t aware it was different to Aus model. OP wasn’t aware it was not Aussie model. OP didn’t question wether it could do both sizes.

  • If not stated that it was a US Import, you can open a Item Not As Described dispute through eBay. If settled in your favour (normally goes the way of the buyer), this will mean the seller will have to pay the shipping return costs and refund in full.

      Unless the listing stated it was an Aussie model or could do whatever the US model can’t how is it ‘not as described’. OP ordered a unit based on a model number and that’s what they got.

  • I would take the return and pay the postage, it sucks from your end though. If they listed the particular feature on the listing them an entirely different story.
