I dont understand why online sellers arent bound to the same rules as bricks and mortar. If i walk into a store and the item is marked at a incorrect price then im entitled to that item at that price. Why are online store privy to a separate set of rules?

    • It depends, like Amazon normally honor whatever "technical issue" they have

      • Yeh but that’s Amazon’s choice though. They aren’t “bound”. They can choose to not honour any time they want.

    • im entitled to that item at that price

      Lol - entitled!
No you are not. Do a little checking.

Under contract law, there is no agreement until both parties agree. You made an offer. Bing Lee didn't agree! So there was no contract of sale.

(Catch only operates the marketplace you bought through. They usually just forward orders on to the seller. So may be unaware of shortages or changes.
BL only offered these through a few stores, so stock levels were likely to be very limited. As there were thousands of clicks, there was not stock to meet such a demand for a clearance item!)

Through consumer bodies, the most you could receive is a refund - which we will receive. (Unless there was a stated reason why they won't sell to you, eg Discrimination. I've won such a case.) They can't force a seller to sell.

Why are online store privy to a separate set of rules?

The b&m store may sell it at the lower price if they are generous, but they are not required to do that under law.
There are often voluntary store or industry pricing policies they agreed to.

Same with online - no difference.
Some may sell at the listed price, or offer compensation if they can't.
Online retailers state their rules in their t&c.

Besides… When you checked out to buy this, you agreed with their t&c!!

      • Discrimination. I've won such a case.

Surely it would be legal to discriminate against people like you!

        • -1

          "people like you!"
          I'll see you in court!💰

That is what that business found to their costs. They had argued that an Australian business couldn't be found to have discriminated against me, when refusing service or a sale, based on my nationality - Australian.

(If they had simply said no, there would be no discrimination, and no case.)
The relevant law differs in different Jurisdictions.

In the State I took the case in, it was against the law to discriminate against "people like you!" - based on Nationality.
In the Federal Court (my other option), my case would not have won, as discrimination based on Nationality was not against the law (at least at that time).

'Won' the case very quickly! (Settled in Arbitration) Got everything I asked for. The business obviously wanted to avoid adverse publicity of a court finding against them. It was still an expensive outcome for them! (Details are covered by a Non Disclosure Agreement.)

Was supported by a State Anti-Discrimination Commision, as the case was in the public interest. And by other businesses who were affected due to the discriminatory behaviour by that larger business. Others have benefited from the outcome, as a model procedure in similar cases.
