Has eBay done enough to stop trading Fake and Counterfeit Items

Is it even legal for eBay or the seller to sell these items?

I understand that eBay has blocked selling some legally dubious items like "FRP locked phone" or "modded console".

However I continue to find counterfeit items being sold on eBay.

I would love to see eBay reports these sellers to cops, and they can be given severe punishment.

Example of possibly fake item:

Usually the title has the word 'For', to save the seller's ass when there is a complaint.

My understanding is that eBay isn't selling the item, but is providing the marketplace. Much the same as you going along to a bric-a-brac sale, or a farmers market.
Certainly there would be / are sellers that will try to rip people off, sell fake goods, etc. And they should be prosecuted. Others may feel that they are happy to buy fake goods (at an appropriate price) - I know I have in the past.
In the linked eBay post, it would appear that 99.6% of 340 reviews are positive. Personally, I would be happy with that. I did note that one reviewer received a non-genuine item and were fully refunded.

To me that sounds like 339 people are frauded. 1 smart enough to return it.

Or, 339 realised what they were probably buying and were happy with the product at that price.

The remaining 339 may realise it 100 days later, and decided to resell it to recover their losses.

What we then have is a used market with fake items.

@Frankensnore: Sounds like you want to eliminate fake items per se; you would need to focus on where they are coming from, not the marketplace.

  • eBay will not normally pull a listing for a counterfeit item in response to a member complaint.
Rather they will only act on a complaint from the holder of the item's copyright.

Ebay will do nothing as they don't want to kill the Goose that lays the Golden egg, so they turn a blind eye to all the fake items sold on their sites, mainly from China.

If a buyer believes that they have purchased a counterfeit item all they have to do is open an INAD case and they'll be refunded.

How have you determined this item as being fake?

Lol he probably reckons an item is fake if aint sold at RRP on ebay and is from overseas

  • Is it even legal

like with anything, only if those people are reported/detected and caught :(

  • Usually the title has the word 'For', to save the seller's ass when there is a complaint.

That won't save the seller if it's a fake. The item specifics states "Brand: Apple" and description says "Designed by Apple".

  • Yes, eBay is already occupied by Chinese sellers, and so is Amazon. Generally, one person manages more than 10 stores, and a company may own hundreds of stores and sell everything, so it is recommended to buy only unimportant and very cheap things on eBay.
