International Flight Ticket Refund (Australian Consumer Law)

Hey Guys,

We booked a Holiday with Emirates Airlines through an Agent (NSW) to Dubai last year (Departure on 19 April 2020)

Due to Borders closing we cancelled the travel- And asked for a refund however the Agent said we can only get a credit for 12 months.

The way things are going - i don't think we will be able to travel internationally any time soon.

I would appreciate if i can get advice on how can i go about getting a refund on the tickets.

    If you booked your ticket through a travel agent, you can choose to keep your original ticket or request a refund, in accordance with our policy. Please contact your travel agent to arrange this.

    Did you book via Credit Card?

    I had the same situation with the same airline. Asked Westpac to step in (easy to submit a claim online) and got the money back in full, in a week.

      My agent stuffed us around. So, did a chargeback with Westpac. It took forever and they needed lots of evidence that we hadn’t received the service, and had tried to contact the airline and the agent. After everything was provided, they went quiet for few weeks, and then issued a chargeback.
      Although, isn’t there a time limit to claim a chargeback. Also, if you have received credits, how will you prove that service not received. Think about answers to these, prepare and then contact your bank.

    You wouldve been better to wait until the airline cancelled your flight. The situation is very different when you have cancelled.
    A charge back wont be possible because you cancelled the ticket.

    "I do not want to travel anymore - can I cancel my plans and raise a chargeback?

    There is no valid chargeback right under the credit card scheme rules where a customer changes their mind and decides not to use the goods or service.

    If your holiday or event is still going ahead but you do not want to go because of COVID-19 (or some other reason), you should contact the merchant directly to discuss your options. The merchant’s cancellation policy will determine whether you can receive a refund or other alternative.

    If the merchant is unable to provide the goods or service to you or has cancelled the service, then you may have the right to seek a chargeback.

    If your reservation is refundable under the merchant’s policy and the merchant doesn’t process the refund, then you may be able to raise a chargeback. This is different to a chargeback for goods and services not provided."

    You will be bound by the cancellation terms in the T&C of the original booking or the travel agents policy at the time of your booking.
