Kogan copped it for price jacking. Is a lawsuit feasible for ebay?

    Even if you wanted to, wouldn't you need to 'sue' each individual seller, and not eBay?

    • Yep. In theory you could sue Ebay for not stopping it, but ultimately it's the sellers doing it not Ebay.

    It's feasible. You do need to pay the lawyers though. Also better have collected evidence or you'll be thrown out faster than Trump.

    Ebay are only a platform for sellers to interact with buyers and as such they don't set prices - the seller does.

    Unless you want to take out a class action against each individual seller, most based overseas, where I doubt if Australian law applies OP I can't see any Lawyer even being interested in considering your suggestion.

    Kogan is an Australian seller/company, completely different scenario.

  • they are a protection racket. I listed something about 12 other people are selling. Exactly the same item. They immediately took down my ad, citing a prohibited product. So I reported the others as a prohibited product. They allowed them to continue selling and making money, but squashed my new competition. I believe this is illegal business practices.
