Parking in Front of Driveway

Can someone get fined for parking on the street blocking their own driveway?

I have a neighbour who does that and it makes very hard for me reverse out of my driveway. The neighbour is a bit weird and doesn't talk to anyone. Just wondering if the blocking of his own driveway done by him is worth reporting to the council.

PS : Talked to the council and they said parking in front of any driveway is illegal. They will send a local laws officer to check it out.

  • I think technically you can get fined for it. But if your neighbor is not blocking your driveway, how is it making it hard for you to reverse?

    • Usually happens during school hours. The street is packed full of cars and when I reverse out and if his driveway is not blocked, I can reverse into it before driving off. At the moment I have to forward-reverse quite a few times :(

        So why don't you reverse into your own driveway when you get home that way you can drive straight out?

    Yes. There was a thread about this a few years ago where a user was booked for doing exactly this, parking in front of their own driveway.

    maybe try talking to him before u report him to the blood suckers at council for a parking fine, like okay hes seems a bit weird but like if u ask him not to first and he stops blocking ur weigh without getting a fine it would acheive the same outcome, except he would save a council fine

  • I had exactly the same issues.
    I used Snap Send Solve to report it.
    They sent the report to my local council.
    This morning my local council sent their staff to my next door neighbour and gave them a warning, and then rang me up to informed me.
    Hopefully the problem solve from now on.

    I get that it may be against council by-laws.

    But the OP is not reporting it for the community good.

    He is doing it becuase he feels entitled to use his neighbour's driveway whenever he wants.

    And what would be the logical outcome for this reporting? The neighbour simply parks on his driveway instead, continuing to block the OP.

    In the end the council is richer, the neighbour poorer and the instigator no better off.

        He is blocking only his own driveway, his parking does not block traffic on the road any more than a verge park.

        Who does he need to 'consider'?

    • If you're suggesting that the neighbour parks on the driveway, blocking the nature strip, I hope he gets reported for that too. (That's an even bigger pet hate of mine.)

  • My entire street does it, including my neighbour. It never bothers me when I reverse out of my driveway, and I live on a section of the street where there is a crest on one side, and an intersection on the other.

    My neighbour and I are not renters, I definitely wouldn't want to stir anything up over something as silly as this.

  • Maybe your neighbour doesn’t talk much because that’s just the way they are. It can be like somebody that doesn’t smile much. They don’t owe anybody these things. Putting that bit in makes it sound like you are intimidated by this and that may be why you are on here asking rather than being neighbourly and talking to them about their parking that is causing you problems and possibly creating a traffic hazard. Reporting should be your last resort not your first if you want a happy neighbourhood. It can be a tit for tat scenario after that which can escalate into a reality tv show.

    There are some properties on the market that have no driveway. I wonder how would you do if you neighbours was one of it. And maybe he s blocking his driveway on purpose? Especially, if you live in a school zone. I know that time to time, i ve got some people who take my driveway as a carpark or will park in front of it and blocking me to get out. And i will have to wait for she/he to come back as there are no one attending the car. Sometimes, i'm really tempt to report the car and get it take away but then i m just feeling that it s adding more financial stress . So leave your neighbors alone and mind your own business. Their driveway and maybe learn how to drive your own car without being noisy to other. . If i was your neighbor i would put up a gate just to avoid you reverse in my driveway. Or maybe it s why he s parking his car there? Because he got enough to see you using his driveway? And maybe he got a small kid/ or someone that need some sleep and don't need to hear your car in their driveway next to their door. People are so entitled nowadays .

      • He is blocking his own driveway not yours so shouldn 't be your problem! And yes, i might be friend with your neighbor as at least he mind his own business and don't care about what you re doing! If you want so much to drive in his driveway maybe think about paying him a fee? For the use of it? As i know, most driveway are a property even driving in and out is trespassing a property! You should be lucky he s not reporting you as a serial trespasser!

          The driveway crossing and layback is owned by the Crown. It is public land which means anyone can use it as long it isn't restricted by law.

          • @whooah1979: Agree. But the driveway on someone property is their propety. I'm not talking about the path or the streer but the actual person driveway in their land. If someone want their driveway to be use as common property they wouldn't bother to block it. Obviously, this neighbor is getting enough of people driving on his land and took it to an extra level. While the law said no access to a driveway should be block ( in case emergency service need the access ) , i think that guy was just tired of having people trepassing his property. Imagine being a homeowner and see so many people like op taking his driveway as piece of road to move your car …

              @Fier2: The op covered this in response to a question I posed a day or so ago. The issue isn’t about parking in their driveway, it’s parking across the driveway in the street.

    It’s illegal to reverse from any driveway on to any street.
    You can reverse into your driveway and if someone drives into you while your doing so they are in the wrong.

    • Not his driveway… As I mentioned I don't care what he does in his driveway.

      When I reverse out, I turn towards his driveway as the street is full of cars and I don't have much choice. Now he is parked on the street in front of his driveway, blocking it fully, which makes it nearly impossible for me make the turn.

      If he wasn't blocking the street in front of driveway, I could still be on the street and reverse out without any issues. My car wouldn't enter even a cm of his driveway.

      Regarding approaching him, I don't want to go into the dynamics of my neighbourhood.

    Wouldn't be funny if she/he is also wondering how weird everyone else and don't even communicate with her/him.

    Regardless this human (lack of) interaction I believe yes, it is illegal to block longways your own driveway.
    Not so sure about parking within the driveway, as in getting in, bothering you even more.

    Also not sure how legal is for you to drive into this busy driveway …
