Kamikaze motorist - OzBargain jury?

Going near the speed limit as it's clear and easy to see the road up ahead giving plenty of time to react to any possible surprises in the distance - this motorist turn into the road and is not keen to give way, he even swerves into my path.

So, is there a rule as to who should give way in this situation?

    The other driver is either a dxckhead or was distracted (which makes him/her a dxckhead anyway!).

    The other guy: I was speeding, on my mobile phone, ran a red light, don't have CTP and I hit another car. How can I get off with a warning?

    From what I can see you are travelling down a one way lane up high on the embankment side with the other one way lane being split down the bottom part of the embankment. The approaching driver, either new to the area or confused because of the apparent line marking (some kind of asphalt joint on the road?) thinks that your lane is a 2 way lane…… they then realize that they need to keep to the bottom part of the one way lane and abruptly turn that way. This has happened to me previously when I was in a new hilly suburb with all these split roadways ie, one way high side and the other way on low side.

      This seems most likely. The other driver wasn't aware that it was a split road. The line painted on the road makes it very confusing as it directs the other driver down your lane.

    • That shiny black line looks to have cause some confusion to the other driver. Nobody died so OP should get over it an move on.

        This is going to be my defence if I ever have to go to court for any traffic related offence…

    • Pause at 00:11, the lane markings along with the parked cars. Could have easily confused the other car to think their right side is where it should be.

      As a granny may say "Thank goodness you are okay son, how about a cup of tea"

  • Both were in the situation of who goes first and the one with the most balls did .
    OP if he didn't notice have ample time with sighting the car to pull over ( not being side by side with a parked car ) but just wasn't aware !

    Generally speaking, the one driving up hill should get right of way. It's old school logic that came out of the bush - if you stop half way up a hill, there's a good chance you won't get going again (traction etc). Either way, it is a lot easier for someone facing down hill to move off again, and pick up speed very quickly.

      The one driving downhill gives way because they have the best visibility.
