International E-Bay Seller Avoiding The Refund

Bought Citizen Eco drive watch from ebayUS seller and only after receiving few days realised that product has been faulty and realised it has been tampered before sending it to me.
After realizing the point that it has been tampered i have raised the issue with eBay and manged to send the product back to the seller. Now after receiving the product by the seller he's denying about the faults that i have raised in first place and trying to avoid the refund. When i initially raised this issue with the seller he seems to be apologetic and accepted for return the product and now he's denying and avoiding the refund.

Ebay has washed their hands saying it's only until 30 days they are covered and it has been over 30 days and now i have to speak to paypal for refund.

Tried contacting paypal all they doing is forwarding me email and comments to seller and he's replying the same comments denying the faults and avoiding the refund.

What are my option to get my AUD$850 from seller and can i dispute the transaction straight to my bank provider and ask for the refund? or what are my other channels that i can tap into to get my refund from this seller?

  • Yes, when i took the pictures sent it to seller highlighting the issue, he seemed to be surprised and straight away started talking about return postage & etc. and i have now sent the item and he has received the item.

      Use paypal / talk to the bank with conversation screenshot as proof. They should have buyer protection.

      If you've already gone through the process of the ebay resolution centre and have escalated a case, made the return and have proof of return (a receipt of tracking number and usually a pic of the return package to the return address) the seller is obligated to process the refund. You need to escalate it through the ebay resolution centre and paypal will start an investigation. If everything checks out you should be ok.

    Goto your bank, preferably credit card company if you paid by credit card, and say item not as described, they will refund you, but paypal may ban your account.

    Did you pay with a credit card using paypal? If it is through your bank it might be harder for paypal to recover the funds as I don't believe that a charge back can be processed.

    As long as you paid using credit card as your funding source then you should go to the bank and request a chargeback. Don’t mess around with this any further. If you paid with cash as a funding source it is going to be an issue.

    The seller already has confirmed receipt of the goods so they are obligated to provide a refund. I would check the seller’s terms and conditions of sale. I would also argue with eBay if you have the time that the seller has the watch back so they are obligated to refund you, although they may not be able to refund you the full amount as it could be classed as “used” - the issue is a he said she said one.

    It is best for future purchases that you always pay via credit card as that is your strongest defence if something goes wrong. Filing a chargeback is normally difficult for paypal to decline and the credit card companies always work hard to get your money back - especially since the seller already has the item back. Note that chargeback processes are tedious and can take a few months to resolve as messages go back and forth between paypal the bank and ebay and you. Also print off copies of all correspondence and cases opened in case things “disappear” or are suddenly hard to locate on eBay. Had that happen before where parts of conversations were “accidentally deleted” or disputes not being “locatable”

    I'd have raised it with paypal in the first place. Paypal is on your side. If you don't dispute it properly with paypal then you didn't really want that $850 back, it belongs to the seller because it was always his, he was the only one willing to fight to keep it. It's like king Solomon cutting a baby in half, if the seller is the only one kicking up a fuss and you're all passive about it not disputing it properly with the avenues open to you, it'll appear that you were never entitled to the money and you're just trying to scam the seller.

    How long since you paid them? Keep trying with PayPal, but I think credit card charge back normally has to be done within 60 days? Still try if it has been longer. Looks like they're trying to drag it out past 60 days to stop a charge back? And like others have said, PayPal may cancel your account if you do a charge back. I would leave credit card charge back as a last resort, but don't leave it too late.

  • I bought the item in April and now ebay says it's out of 30 days buyers protection period, so i have now in contact with paypal.

    Hope paypal can resolve this as seller being real painful and trying to dodge the refund.

    Never heard about charge back option, can i still do it even though i have paid through paypal but with my debit card? Is charge back applicable though debit cards?
