Who to contact if a company doesn't honor their own competitions?

If a company is having a promotion where you can instantly win a prize, and the prize they try give you is not the prize you have won who do you contact?

Is there some national group that watches competitions? or is it ACCC? Or is there a better suggestion?

  • It would probably state in the T & C of the competition. I believe you have to have a licence for each state you are running the competition in, so whoever gives out the licences would probably be the group. Is this a hypothetical question or is there a particular comp that you have an issue with?

    • Doesn't say in the T & C (Or at least I couldn't ind it in there).

      It's a particular competition that started recently by a rather large company.

      While it's true that the T&C MAY have a mis-print I find that hard to believe as calculating the total prize values add up to the total value stated in the T&C.

      They are trying to give out a prize worth around 50% of what the T&C says.

      I'm going to see what happens tomorrow or next week (didn't wait to accept the cheaper prize today so I didn't claim it). If they still refuse to honor it then I might submit a complaint.

    They prefer written complaints.

    Even if the promotion does not need a permit number they still need to abide by the act.

    Rules vary by state. Even if the company running the comp. is not in Victoria, if it is open to Victorian entrants they must obey the Vic. rules.

    What did you win and not get?

    • Lets just say it's from a rather large worldwide franchise which started a competition recently which includes instant win prizes of various values.

      Yeah you can probably work it out from that :P

      T&C Says the prize is $6.25 RRP and they are trying to give me something which is about $3.00 RRP.

      Yes I do realize I'm making a big deal out of a $3 difference, but that is 50% and with the total number of winners for this one thing it works out to over $3 million less than the T&C Claims.

  • What's the reason for not telling us what the comp is? It's a bit hard to say what the RRP is without knowing what it is.

    • I know the RRP for the item they were trying to give me is aprox $3.

      I'm not guessing it, it's just a rough price though (I think it might be $2.85).

      I'll find out the RRP tomorrow.

  • OK, based on the email you just sent me, it sounds like the prize they are giving out at 1 particular location of this company is incorrect (offering a small widget instead of a large one). Have you tried collecting your prize at another branch? If it's happening at more than one branch, I would contact the head office. They may end up sending you some freebies!

      • Neil is giving you some good advice. The head office of this company would like to know that one of their branches isn't honouring a $7 prize. Slap on the wrist for the branch I would say.

        One thing I would say though, if you do that and you are able to claim the prize from the branch in question - steer well clear if it is food! :p

        • Called the head office this morning and let them know. they are going to follow it up and get back to me within the next few business days.

  • T&Cs usually allow for substitution for a prize of equal value in the event there is a problem.

    I am always just happy to have won something, anything really :)

    • If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.

      The problem is the prize that should be given IS available but the store refuses to give that prize, instead they are trying to substitute it with a prize of much lesser value.
