(SOLVED) Am I Responsible for People Parking ? (Diagram Included)

My neighbours are threatening that they will be going to the council because every time someone comes to my house for 5 minutes or less they park in that spot.

My question is am I responsible and can I be fined ? I don't even drive or own and a car so I personally have never done it.

Major offenders are courier drivers and fast food drivers.

    If that is the whole story, let them.

    • Literally everybody uses it as a car park when stopping by my house even my real estate agent does it.

    Of course you're not responsible for randoms parking somewhere they shouldn't.

    • That's what I figured but my neighbour is making it out as its my fault.

        Sounds like they're just trying to fix the issue with the least effort by complaining to you and hoping it scares you into doing something about it.

    Let them go to the council. Agree with them about the poor parking to throw them off guard. You have nothing to lose if you don’t park there and you don’t have a car.

    Can you provide a real-life photo from Google Maps of the place? Top down.
    The answer depends on the distance between the line and the driveway.

      • That doesn't look like it is meant to be used for parking and if a longer car parks there, it is actually blocking the driveway. I think the neighbors might have a case against you.
        For couriers or delivery drivers, it is not your problem, let them cop fines and let neighbors complain.
        If you have friends/relatives coming to park for 5 minutes, make sure they stay in the car or near the car as to show you are willing to move the car anytime they want to go through the driveway.

        Also, keep in mind, you can get a fine even if someone just takes a photo of you parking in a bad spot and sends the photo to the council. The council/rangers don't need to be physically there to fine someone.

        • My friends and family are aware and don't use it as a park its just everybody else who is just stopping by for a few minutes.

            You won't get fined and you can't be responsible for this AND you are not breaking any laws.

    Let them complain to the council and perhaps the council can do something about it.

    Ie. Marking the spot with a not a parking spot sign or yellow boxes.

    And this impacts them how? If they are truly coming and going in 5 mins, then who cares.

    If they are parking for hours on end, they they have something to complain to you about, but its still not you who is responsible for other peoples parking.

  • As far as I know, no you have no responsibility, even if you wanted to, as its not your land you don't really have a say on it.

    It's illegal for others to park there as it obstructs a driveway though unless they're just dropping off/picking up passengers within 2 minutes. But the fine goes to the person doing it, not you (also I'm NAL).

    In Victoria you can actually block a driveway for <2 mins when picking up/dropping off passengers until it becomes illegal, so even if they were blocking it, it would be fine if under the time.

    Just tell them they’re there to pick you up.
