[QLD] Fine Referred to SPER - but Never Got Original Notice?

Hi guys,

I drive a company car and caught done speeding <13km in December. However we never received the original notice at HQ and now the debt has been transferred to SPER.

Company policy says I'm responsible for all damages/fines but I dont have the option to do the stat dec to say it was me driving and cop the normal fine?

I tried to call SPER but it just has an auto message saying they're busy now and to call back tomorrow.

    Don't call SPER, they are there for enforcement. Call the agency that issued the fine in the first place.

    I had a fine referred to SPER and never got the original fine. You need to call the original issuer to get them to reissue and fill in an Application to Cancel Enforcement Order to send to SPER.

    Thanks guys I called the 1300 number for Qld road safety office and they said do stat dec and they’d reissue and withdraw at sper.

    Mentioned I never received it and to which they adamantly said I did but couldn’t provide tracking. Hopefully this stat dec will finalise the issue.

    I also have just received a notice from SPER for a speeding fine on December the 6th, I did not get the original fine. I contracted QLD road safety and they sent me an email form to fill in. My thoughts were our post offices overwhelmed with Christmas . or was there .stuff up in sending out the originals. Not that this makes a difference I did speed I think so pay the fine but do not want to pay extra for someone else mistakes

    • Same. Not disputing the ticket. Just disputing that i ever got the original and now have to deal with the stress of receiving this SPER notice. Bit of a cop out there is no tracking on the letter.

  • I don't know how things work in QLD but don't they usually send you a 'final notice' prior to referring it to debt collector?

    • No says on the website no reminder is sent. (Yet again another cop out).

  • Wow, that's terrible. Can you ask the debt agency to waive any additional fees?

    • it's not a debt agency 'per se', but rather the Queensland Government State penalties Enforcement register (Agency). they have far ranging powers including cancelling your driving license, seizing property, collecting monies direct from wages or bank account etc… if a fine is not paid.

  • Just reporting back - i sent in the stat dec with a letter that further explained the situation with reference to the staff member on the qld road police service office's advise. About 10 days later fine wad reissued with a letter saying sper enforcement had been withdrawn. Thanks for everyone's replies but the road authority definitely did not make this a straight forward affair.
