Do Businesses Have to Provide Their Physical Legal and Postal Addresses When Requested?

From what I know with my humble legal background experiences, businesses registered in Australia have to provide their physical/ legal address when requested. That should include those notoriously elusive types like Airtasker Airbnb etc… or am I dubiously mistaken?

    There's no such blanket requirement, for the simple reason that different sets of laws govern companies vs partnerships vs sole traders.

    But effectively you should always be able to find their address: anything with an ABN will have a registered address (and they have to give ABNs on tax invoices) and anything that's a Pty Ltd will have a registered address. Both of these you can find on ASICs register.

    • You'll need to find the actual legal entity. Large businesses like Airbnb will operate through a group of related companies depending on country/etc. So e.g. Airbnb:

      Website:

      But it says Airbnb Inc. (which is a US, not Australian entity!)

      Usually a websites terms and conditions or privacy page is a good place to find the relevant legal entity:

      https://www.airbnb.com.au/terms/privacy_policy

      Search for "Australia" and you find the following:

      If your country of residence is Australia, the Payments Data Controller is Airbnb Payments UK, except if you book a Host Service located in or outside of Australia, which is confirmed after January 9, 2019 at 1:00 AM UTC, in which case, the Payments Data Controller is Airbnb Payments Australia Pty. Ltd. (“Airbnb Payments Australia”) for that transaction.

      Et voilĂ .

      And then you can search for "Airbnb Payments Australia Pty. Ltd." on ASIC here:

      https://asicconnect.asic.gov.au

      You'll need to pay $9 for the current company details for the full address though, the free summary will only show the suburb.

      That's an example for Airbnb. Most companies' addresses can be tracked down similarly.

      Additional note:

      The Company search might show a few different addresses, place of business is if you want to physically visit (not always possible), registered address is if you want to serve legal documents.

    Corporations have a requirement to provide their physical and postal addresses to ASIC. Not to you.

    Same with registered businesses post ~2015 if they aren't a corp. There's still a transition period in effect so some legacy BNs are under State regs still.

    What exactly are you hoping to achieve? You'll have to provide some more info if you want assistance here. AirBNB (for example) have literally oodles of corporations, body corps and trusts they use to protect their interests for the reasons that you've discovered. Same with whatever company you're seeking details of.
