Nothing about the bin policy
I think the store would then have to demonstrate reasonable attempts to contact the owner before disposal. 30 days is on the aggressive side. I would check Cash Converters' policy on seizure. They have probably done their homework on the laws.
I assume bin means sold on Facebook marketplace
Did they charge him for the work, and has he already paid for repairs?
No he was going to pay and collect it.
It sounds like someone needs to buy a new laptop.
So a friend gave his laptop
Sure
Too bad titles aren't editable.
Did your friend email the repair shop while he was away for a month to see how the repair was going?
Holding it for only a month seems a bit severe as it would not take up much space. Odd that they did it spot on the one month time limit?Don't know where your friend is located. Find info relevant to your friend's state.
Uncollected goods are items that are left for repair or other treatment and are either left with or without payment. When goods have not been collected for a period to time, the business should follow the Uncollected Goods Act 1995 to dispose of the goods and to cover any costs involved in repairing and storing the goods.
How a trader can dispose of uncollected goods depends on their value. Any money made above costs (incurred by the business, such as freight, storage, disposal) should go to the Chief Commissioner of Revenue NSW. Local Courts administer the laws relating to uncollected goods and should be contacted for more information if there is a dispute.
Value of goods Manner of disposal < $100 The business must give a verbal or written notice to the customer that they intend to dispose of the goods. If the goods are still not collected after 28 days of that notice, they may be disposed of in any such manner as the trader considers appropriate. $100 — $500 The business must give written notice to the consumer and each other person claiming an interest in the goods, that they intend to dispose of the goods. If the goods are still not collected after three months of that notice, they may be disposed of by public auction or by private sale for a fair value. $500 — $5000 The business can only dispose of the goods by public auction and only if: (a) written notice has been given to the consumer and each other person claiming an interest in the goods of the intention to dispose of the goods; and (b) the goods are still not collected after 6 months of that notice; and (c) a copy of that notice is published, at least 28 days before the goods are disposed of, in a daily newspaper circulating throughout NSW. > $5000 Goods worth more than $5000 can only be disposed of with a court order. So how long did your friend leave the laptop with the repair shop? This whole setup sounds odd? Did the friend leave a contact email address?
And how much was the laptop worth?
More than a month, yea he did.
The laptop worth around 2k brand new@newbiesh: Be interesting if in NSW and still worth more than $500, the company could be in a bit of trouble.
@tomsco: He is qld and the laptop I just checked worth 2k brand new on eBay he purchased it 3k last year
@newbiesh: https://www.qld.gov.au/law/laws-regulated-industries-and-acc…
Seems in Queensland value is irrelevant. Store had to wait 6 months.
@newbiesh: Can your friend take them to QCAT?
More than a month, yea he did.
Yes, we know it's over a month (~30 days), but how much over? Was it 2 months or 6 months?
How long was the laptop left at the workshop?
Don't know why you've been negged for asking.
OP said that it wasnt collected within 30 days and, when asked, has said that it was "over a month". We already know it was over a month otherwise it'll be within 30 days and wouldn't have been disposed.
Im pretty sure the shop wouldn't just "dispose" of it on the 31st day.
yeah, pretty much between 32 days and eternity is over a month.
Lol he didnt throw it away, either sold it or gave to someone he knows. Sue him.
Nah, really?? I'm shocked I tell you, shocked! :O
I know!!! World shattered!

The laptop worth around 2k brand new
Why did your friend take it to repair shop when it would still be under warranty?
Or is it yours? -
Computer Repair Shop Threw My Laptop in Bin for Not Picking It up within 30 Days
Maybe that repair shop IS the place to do the warranty at….
I think OP means it was $2k when brand new, not that it's worth that much now.
Yea I meant 2k if buy new now on ebay, it was purchased for 3k but been used for a year
Oh well, it's gone now.
Harsh.
What was wrong with the laptop?
Won't turn on needed a battery apparently
If it's only a year old it'll still be under manufacturer and/or statutory warranty.
Why take it to some local dodgy repair man?
More than a year old
@newbiesh: It’s still covered by statutory warranty….
@Skramit: You’re only rubbing it in.
What does his paperwork say?
