Seller trying to get out of their own promo

I've made an account just to ask for your thoughts on this scenario but will stick around and try to post some deals where possible.
So the situation is the seller were offering a promo where if you spend over $99 they will throw in some free gifts with the order.
The site is also offering free shipping on all order above $99 so I've made a purchase and PAID $105. I've tried to contact them and the

First reply were there is no such promo. So I replied back with the Paypal transaction ID and the promo link.

Second reply saying that I only spent $95 which I ASSUME that they have taken $10 out for shipping (as I know there is no such things as free ship) but as stated above the site is offering free shipping above $99 so I was thinking are they allow to do this? What are your thoughts?

Update:
So I followed Jar Jar binks advice and asked the seller to point out the cost that they said I paid.
I then got a replied email "We will ship you the free gift today." so I guess they finally decided to honour their own promo but I wouldn't know it its actually shipped but will be sure to update on this as well.
I may also add the 2 reasons why I made this post are 1) Other stores do have the item that I want for cheaper but with the free gift taken into account this store is slightly better value so I decided to give them a try 2) even though the gift weren't of a great value I think that as consumers we shouldn't tolerate this kind of behavior that sellers are doing

        • My comment was before the OP added the invoice, based soley on the forum post (the only information made available initially). The link and additions were added an hour after the OP made the post.

          The invoice makes things a lot clearer. The OP spent over the $99 limit.

      Yes I paid $105 as the matter of fact the original price were $116 but drop down when I applied coupon

    You'd probably find that most sites offer free shipping and/or gifts are the stated amount is exceeded in your cart.

    When you paid $105, you knew you were paying $10 for shipping, and wouldn't have exceeded the amount for a gift.

    Move on.

    • No, if a website claims free shipping over $Xx amount, it's free shipping. OP did not need to believe he paid $10 for shipping.

    Did you pay $95+$10 shipping OR $105 on item with free shipping?

    If it’s the first: No. You get nothing. If it’s the latter, well then yes you should get those gifts.

    I don't get why people are saying OP has only spent $95.

    OP bought $105 worth of goods. If they had to pay for shipping it would be $115 total. Just so happens there is free shipping over $99 and a free gift/s with over $99 spend.

    I think OP should be entitled to the free gifts for sure. It is FREE shipping, so $105 spent = $105 on goods, shipping would be extra on top

    OP is right, retailer is wrong. OP did spend over $99. The promo was based on shopper's spending, not retailer's net revenue.

      People are assuming OP paid $10 for shipping, when in reality they didn't.
      Because otherwise it would've been $116 - $10 = $106 before discount.

      So yeah, OP is in the right and the seller is in the wrong.
      Free Postage is common practice, but I can't understand why Seller would be angry about "free gift". Usually these stuff are pretty crappy or cheap items anyway. The only way it makes sense is if Seller ran out, or is a kant.

      Would happy to share the link but I would rather ask for your thoughts on the matter and try to sort with the company before name and shame

        It's less about name and shame, and more about trying to fill in the blanks created by your cropped invoice.

    Was your cart >$99 without shipping? I feel like you're trying very hard to avoid this fact.

    If it was $95 + $10 shipping, the store is right. If it was $105 with free shipping then the store is wrong.

    Just to clarify on the shipping thing. I did NOT paid for the shipping as my order was above $99 the price that I paid for was just on the items that I bought + gst. The reason I said that $10 shipping is that it is what I assume the seller will try and say that's how much it costs them (as someone would have to pay for shipping) to lower my order value.

    Here is the email response I recieved with some redact:
    First reply: "There was no free gift running when you placed your order sorry."
    Second reply: "The order needed to be over $99 excluding shipping and your order was $95.17 excluding shipping.
    Sorry for the inconvenience." hence my assumption

      Poor form from the seller. Ask them to show where it says you paid $95.17 on your invoice and threaten with Fair Trading if you can be bothered.

      • Interesting you brought that up say if I were to raise a complaint and the store is in a different state (qld) and I'm in another (vic). Do I raise it up with fair trade vic or qld?

      It's not too hard to work out the name with a bit of googling. The promo code seems to be "DREAMS10".

    Don't get why people won't share the name of the companies on posts. If you want a result as there's a good chance someone from the company will be on here, say it and let them know.

      • Then don't post the grievance if they're that worried about revealing the product. Most aren't anyway. Rather help other people from going through the same thing if you're gona post it.

  • Usually it's discount OR free shipping but it's hard to tell without reading the fine print
    IF they are wrong…they'd need to be an Australian company to pursue or ha v e some protection through your credit card or other payment method

    • Just thought it is irrelavent and I was a member of a company to get the code so I don't suppose sharing the code around to the public would be a good idea

    OP, from the limited invoice photo you gave us, it's pretty obvious shipping was not included, the "tax" was GST, and the company decided you only spent $95 without tax, therefore does not qualify for the gifts (but because the online shopping portal was probably designed by competent people, you got free shipping).

    The company is unlikely Australian or lack signficant experience in doing business in Australia.
    Their reply to OP even confuses GST with shipping.

    OP is completely in the right, if they advertise as free gifts for over $99 spend that spend is WITH GST.

    Please name and shame.
