Sensitive Subject: What Happens if after Selling QFF or Virgin Points, The Seller/Buyer Get Caught? What Are The Rules?

Hey there,

Just wondering..

Let us assume person A sells 100,000 points to person B for $ 1,000 today.

After a week, QF/VA contact person B saying they are confiscating the points. They contact person A and tell him/her he is banned.

Person B is out of points and money.

Person A has $1,000 but has no way of getting the points back.

Should Person A refund the money? Is that the general rule here? Or such discussions are agreed upon before selling?

Or is there a safer way to sell points?

Thinking of buying may be early next year, but can't find any info or general rule sets regarding this scenario.

    Person A fulfilled his/her end of the contract - sending 100,000 points.

    Person B fulfilled his/her end of the contract - sending $1,000.

    The transaction is complete. There is no further liability.

    It is a tricky one because I have heard of instances where person A has contacted QFF, apologised and actually had their points reinstated. Person A shouldn't keep the money AND the points.

    Well both Person A and Person B know they shouldn't be trading points.

    A bit out of context but maybe a simple example is a drug deal. The seller and buyer both know it's against the law. The buyer gets caught and her/his drugs confiscated.

    Does the buyer then go to the dealer and say oopsies, even though I can't return the product can I have my money back? Even though we both knew we shouldn't be doing this in the first place?

    If you were Person A what would you do? Because I'm not sure if Person B can expect a guaranteed risk free transaction when benefiting from playing against the rules…

    If Person A gets the points back the right thing to do is to return the cash to Person B otherwise they'd be profiting from nothing. But lets put this in perspective and here's a question for you. Say you found $100 note on the street, do you actually try to find the owner or donate it? Or do you struggle with this for a few seconds then simply pocket the cash?

    How do you know Person A won't sell you the points, then fess up to QFF and attempt to claw back their points after transaction? It sounds like a win-win attempt. Even if they don't get the points they keep the money anyway.

    Like anything else in life, risk v reward. You want to game the system to save on airfare, you take the risk of being taken for a ride or getting your points confiscated.

    I think your poll is kind of pointless. Assuming the seller doesn't get their points back the responses have to be just about all its buyer's loss. Sure you can talk about it prior to purchase but if there are any sellers out there who would be kind enough to offer me points at market value and a 50% refund if I get caught buying, please PM me or put your hand up. You'll be very popular I imagine.

  • The slightly safer way as has been mentioned on here is to get seller to buy the ticket I heard. A good seller may suggest doing this. Not sure if that loophole has been closed up since.

  • Sounds like you took a gamble attempting to sell QFF points and lost.

    Bad luck. You knew (or should have known) the risks of violating Qantas' terms and conditions.
