A Crash at an Intersection (Who's at Fault?)

Recently got into a car crash, but don't know who's at fault. I'm turning into an intersection, the lights are green but no green arrow, and it was clear no cars, nothing. As I turn in a new car begins to drive out of parking next to the butchery, a 4WD, and runs it into the left side of my vehicle, who's at fault? Cos I didn't see him come out until I was turning in already.

  • It's possible the dude sped up on purpose when he saw OP - some kind of insane lesson teaching thing. I've seen it before, an old dude cut off a ute where the ute had to mount the curb. The ute then just angrily purposefully swerved into the car to hit him even though he had the choice of just driving away.

    But even if that's the case OP's still at fault because legally he's meant to give way, not the other driver.

    • OP may not see it and crash into that as well.

  • Insurance company is gonna side with him 100% (Unless he is honest person, which is unlikely to happen).
    You have no dashcam, you have no proof at all this is what happened (That he left the parking as soon as you turned and hit the gas as hard as he can).

    They will go with what seems logical, right now to me it is that you are at fault.

    Me personally, I have no idea because there are so many factors I need to know. Were you really slow? Was he driving really quickly etc..

    Also, based on your photo…I find it hard to believe that you even managed to get hit by him. He was pretty far away, so unless he had one of those sport cars that goes 0-100 in 2 seconds then I doubt he would be going fast enough to cause this unless you were insanely slow in your turn. Maybe the guy just wanted insurance money for his old 4WD, so he saw an easy target dunno

    Based on the damage also, it could have been that he just hit the brakes really hard but it isn't strong damage so I'm guessing you were just really slow turning.

  • Wow. Just wow. If only Op's driving were as good as the diagram that clearly shows OP at fault. If you are turning it is your job to wait until it is clear and to ensure it is before proceeding. Unless the other party was intentionally trying to hit you, you failed to do so. But not content with that you have to ask the question because you're hoping someone will reassure you that you aren't at fault? You know you are. This is just a waste of time.

    • I cant imagine a 4WD accelerating fast enough to go from zero to speed in the intersection to ram OP. That said, OP could have been crawling through the turn.

        Much more likely explanation is that the OP just failed to look properly. I'm not saying other explanations aren't possible but that really is the one that fits best IMO from what facts were presented.

    Per most times I'm seeing a correlation between OPs driving ability and their actual knowledge of road rules..

  • According to insurance, the one making changes will be the fault. It is your fault as you are turning while the other car was going straight unless you can show a footage that the other car went pass red light and hit you.

  • If you were already turning in the intersection, the guy should have seen you since there was no one else blocking view. But it doesn't add up, the guy would've been flooring it to hit you from that driveway, he would have decided to purposely hit you then.

    Based on your diagram, you are clearly responsible.

    Parking doesn't start until the brothel, sorry, blacked out 'massage parlour', not the butcher. That is 20 meters from the intersection. The only way they could have been too quick to see was if they were ripping a mad skid, but you should have heard that.

    Please cut up your drivers licence.

    On a side note, it is weird having 'Halal Meat' over the door of a 'massage parlour'.
