Tax Invoice from an Ebay seller

Hello, I bought Samsung S10+ 512GB from a seller on ebay (eclipse_estore_au)
As I'm going overseas and got it as a gift for my sister I was hoping that I could claim back the GST paid on it, which would be aprox. $120
I contacted the seller and they said that they don't provide GST invoice for GST claim purposes, the did provide me one for warranty purpose but it does not mention nay ABN number of the seller
I've attached the link of the seller below, can someone guide me if there is anything that I could do in this case to claim back the GST when I leave the country.

    the seller must have an ABN and the tax invoice must have your name and address on it.

      No they don't. They don't need to be registered for GST at all to sell on eBay, so they don't need to give a Tax invoice. They do need to provide a receipt.

    • I know that, but the seller is refusing to provide me one, they say
      me: "Can you provide me a tax receipt with these info, my name and address is already provided when I ordered, please include your ABN, thanks"
      store: "We do not provide ABN for this purchase, since there is no GST applicable, ECL is not registered for GST."
      me: "I won't be able to claim GST that way, I need these details provided in screenshot to claim GST." (I provided the a screenshot showing which details need to be on the invoice, as you mentioned too)
      store: As suggested earlier, the invoice we provide is only applicable for warranty claim purpose.

      What else should be done?

        You are just going to have to wear this one and take it a life lesson. You cannot make them give you a tax invoice when they are not registered for GST.

            @DeeJayAhmed: Ask them again. They have provided you with a tax invoice which shows that you you paid GST. You can tell them you'll be reporting them to the ATO and see if that gets them to write their ABN on there.

            Alternatively you could always try doing a charge back with PayPal protection. Australian law requires that you are provided a correct tax invoice and as such when buying an item it should come with a tax invoice once you have requested it. They havnt provide you what you paid for.

        They didn't collect GST, you didn't pay GST, there's no GST to claim back. Pretty much end of.

        Though….. yeah their invoice is incorrect. It shouldn't show a GST amount in this case.

    You won't get GST back as the seller didn't register for GST. But for the amount of feedback he had, he possible sell more than $75000 a year.

    You should report him for tax avoidance

      I'm leaving in few days, i guess i should have asked them about the tax invoice before ordering and opening the package.

    Seller is Hong Kong based, thus why generally not GST registered. However with the things he or she sells and the amount of sales she or he could easily reach $75k in a year, thus need to be GST registered.

      The price declared on the package was $899 lol, maybe thats how they are avoiding paying GST/custom stuff

    looks like its supressed if you try to search it directly on the ABR, but google spits out their ABN anyway

    and it appears they are registered for GST.

    (and having seen your google drive invoice, if you can't get them to re-issue one I'd just find some way to put it on)

    If you look up that ABN it's registered for GST and is active but the name is suppressed (I don't know why).

    If you google Julian Technologies there are a lot of bad reviews including here at OzBargain.

    Good luck going forward if they won't even provide an ABN

    Okay. I had a look at your invoice and the link to the seller.

    Just because the seller’s invoice shows an Australian address doesn’t mean that the product is Australian based.

    The link to the eBay account details shows that the seller is in Hong Kong.

    The product may actually be shipped out of their Hong Kong operations in which case no GST would apply. Companies such as Kogan employ this tactic so buyers don’t pay GST and therefore can’t claim GST. So demanding a GST invoice when they can’t give you one is simply a storm in a teacup because they legally can’t give you one if it is shipped out of their HK operations and the HK business is operating under a HK or other foreign company.

    You should also be aware that there is nothing the Australian Government can really do to force companies selling more than $75,000 in goods to register as a foreign GST collector. There are still many sellers overseas who do not register to collect GST and send it to the Australian Government due to all the administration work involved. The cost of chasing overseas retailers to register for a business of their size would probably yield a nil result because they would have to engage lawyers overseas and in Australia to take them to court both overseas and here. It would be a negative gain for the tax office.

    The Government was sucked in by Gerry Harvey and his cohorts and it is now costing more than double the GST collected to collect the GST on these small value imports. The supposed level playing field that Gerry Harvey preached hasn’t eventuated. People are still buying from overseas and using work arounds to not pay the GST.

  • Buy on ebay, expect the unfiltered dodgey sellers to do dodgey things.
    ebay buyer beware.
    ebay is still very much an unregulated selfish garage sale monopoly that washes it's hands whenever they want.
    It only survives because of bottom of the barrel sellers that do dodgey things attracting buyers who want the cheapest price and then find they got screwed somehow.

    I guess the lesson learned here is to ask if they can provide a Tax invoice before you buy the product.
