Background Check - How long does it take for a record to clear?

Hi. I was just checking to see when a record would be cleared, as upon appeal, the conviction was quashed (or so we thought?).

Result: CONVICTED AND RELEASED ON ENTERING RECOGNIZANCE SELF $500 TO BE OF

    10 years for a conviction to become "spent" assuming no other crimes committed since then.

      A more likely scenario: things got a little heated on League of Legends one night and the OP threatened to locate the offending ruffian and have an IRL discussion with him and/or his mother, while performing acts upon their personages.

    What does the conviction was quashed mean?

    Were you found guilty or not guilty upon appeal?

      "quashed" means annulled, cancelled, etc.
      i.e. the appeal was successful and the conviction overturned (but apparently not?)

  • If you plead not guilty in the original case but were found guilty, then made a conviction appeal there would have been one of 2 results.
    Your conviction would have been quashed and a retrial would have been ordered or you would have been acquitted.
    Were you acquitted?
    Even if you were acquitted then in some but not all circumstances, your criminal record may state the original charge.
    What is the context of your criminal record check that revealed the original conviction?

  • The ten year statement that everyone is making is “mostly correct”

    Convictions are shown on your police check for a period of ten years OR if relevant to reason you are seeking a police check.

    So some convictions can still show after 10 years of the “crime” is relevant to the industry you are seeking the check for. Think financial crime and going for a job at a bank etc.

  • I have a 30+ year old conviction for disorderly conduct still on mine (my only offence)Looks like i should follow this up.
