Dealer Wrote The Wrong Odometer on The POS Receipt and did other Dodgy stuff, what should I do?

Hello, people just purchased a car two days ago from a dealer and noticed he wrote the odometer as 130k when it is 135k. I have asked him to write the correct odometer reading but he is not replying every time I ask this question.

I am wondering if he may have done in case I request a refund (if it turns out to be a lemon) he might try to say that I used the car a lot and justify it is a reasonable distance to have traveled to require a repair.

I have uploaded a video a day after to the cloud to timestamp the odometer recording date.

Also, he tried to ask that I put down on the receipt to provide to RMS the purchase price is 1.4k when it was 2.7k, for me to'save money on transfer fees', I thought if I tried to get a refund he can back himself up so he will only need to refund 1.4k, he tried to seem a bit angry like I'm troubling him when he was trying to help.

He also tried to claim at the end after wrapping the sale, that there was no warranty when he promised a 1-year warranty, now he is going to be giving to me today, he kind of said oh I sent you an email right(like he was checking there is physical evidence [which there is]).

He wanted cash payment too because he says that I 'save on tax'.

I asked him also the terms of my deposit is that he provides an authorized inspection checklist which he agreed to, and at the end he claims that the registration check is the inspection check to register it (at the time I had already spent a whole lot of time and he seems to be acting friendly throughout and saying nothing to worry about, by the time I did not want to waste more time).

I have known him for a year now, seems to talk to me three times when we crossed paths in the mall nearby, and now that I'm more diligent(but apparently possibly not so much considering I purchased this), I have realized the dodgy things he does. He seems to act like im his friend but when it comes to these small details he tries to save himself and make it look like im being too paranoid by taking precautionary measures and asking questions, and makes it look like I don't know what I am asking.

It seems he keeps trying to act friendly but does dodgy things, advise on how to pursue this without breaking the potential 'friendship' we might have. Yes Im probably being used, but just incase he is legit and just does not want to encounter unforeseen expensive repairs.
I think from my experience of dealing and reading reviews pretty much most dealers are dodgy and has done dodgy things, so this seems liked my best option.

He says he might let me do a trade-in if for a better car in 3 months time (once I get job path i take secure if i get a new job and im stable or decide to stay in current company, and my partner has a visa).

Should I request a full refund if he does not update my odometer to the correct amount AND (obviously will definitely ask for a refund if he does not give the 1-year warranty by today)?

Also what rights do I have with regards to a free repair, if I have an expensive repair ($500+) that is not covered by the warranty within 6 months since purchase (it is registed for 3 months)?

    130k may have been the odo when it came into stock. Form 4 should show the 2 different odos, though this isn't always done

    Yeah pretty dodgy. Doesn't seem like NSW have a $ amount for stat warranties, only age/kms.

    Just a note, buying a $2700 car from a 'dealer' is always a stupid idea. You bought from a wholesaler, not a dealer as such. These guys take the trade-ins that the major dealers won't touch.

    Please tell me you did a PPSR on the car.

    How old is the car? What sort of car did you buy?

        Why didn't you just buy privately from Gumtree for a $3k car?

        • the dealer provided warranty for 12 months as an extra $$ otherwise would be cheaper (which he tried to claim not provided) but now says he will be giving it.. still waiting.

            @TroydonAnabolic: They're a wholesaler and it's a $3k car, it's highly likely that 'warranty' won't cover much. Plus as you have picked up the car but haven't received warranty paperwork, I doubt you're gonna get any. If you didn't get it when you picked up the car, you're not getting it.

    OMG, a used car sales person acting dodgy…..I'm as shocked as you are.

    Used car statutory warranty -

    A used car statutory warranty applies on all dealer-sold passenger cars that have travelled less than 160,000km,are less than 10 years old, and do not exceed the luxury car tax price threshold. The warranty is valid for three months or 5,000km from date of purchase. This warranty covers most items on a car related to safety, reliability and roadworthiness.

      The dealer is obliged to give consumers a Form 5 which states there is no warranty under the Motor Dealers and Repairers Act 2013 and must also provide a Safety Inspection Report issued in accordance with the Traffic Act 1909 stating that the vehicle is roadworthy. This Report must not be issued more than 42 days before the date of sale unless if the vehicles registration has been renewed or established within 90 days prior to the date of sale, the inspection report relied on for this renewal or establishment is sufficient.

      • Your car is >10yo, there's no warranty, regardless of mileage

            @TroydonAnabolic: Did you read the conditions of the warranty paperwork? Limit of claim amounts etc?

            You said he was providing the 1yr warranty yet now you're saying you paid for it… Is it on your contract of sale or not?

  • There seems to be a lot of second guessing and overcomplicating on your part. Why don't you just cross out and write the correct ODO reading and get him to counter-initial? In most states you have 1 to 3 day cooling off period after signing a contract (though this is probably over now) where you can walk away.

    The warranty is a seperate issue from closing the deal. You must realise you are buying an old car, what do you think is reasonable for the trader to 'warrant' on such a deal? All they can warrant is that it is in reasonable condition for its age. It's up to you to decide if you are paying the right price for this car. Other than the statuatory warranty (not applicable for this age of car) you can purchase an additional warranty which is usually provided by a third party. Did you negotiate and pay extra for the warranty product? The warranty is like an insurance product and you should read the terms to see if its worth it to you before paying any deposit…

    There are ways to be assertive and diplomatic without ruining the 'friendship.' Just be like "Hey, I am still waiting for the paperwork on the 12month warranty that was agreed on the sale, I am keen to review this prior to picking up the car and finalising the payment."
