Demerit Points and Need to Inform Car Insurance NRMA

Received a ticket for a passenger not wearing a seatbelt. In fact they didnt have an ID on them so the driver got charged $330 and 6 demerit points (public holiday)

I was wondering what's his duty to inform his car insurance company (nrma- which he has both comprehensive and CTP with)?

Also the cop said he would have given it to her if she had any ID, can she just do an affadivt or something or provide the ID later?

  • None. AFAIK you only need to advise them of accidents, not fines.

    Also, AFAIK, the driver always gets the fine and loses points…They are the one driving, not the passenger(s). What if the passenger doesn't have a licence or they are children?

    Am pretty sure regardless of ID situation, driver is always fined if someone is not wearing a seatbelt in car as its the drivers responsibility to ensure everyone is wearing one.
    So chances of having ticket transferred to passenger is almost zero.

    As for informing your insurance company, it never hurts to let them know, but they usually are more concerned about licence losses etc
    if in doubt, call them and let them know regardless.

    You only have to tell them about points if they ask when applying for a new policy.

    Any disclosure requirements for your current policy will be listed in the policy document and you should acquaint yourself with the details of the policy.

    AFAIK, you both get fined. The passenger for not wearing the belt and the driver for not ensuring the safety of the passenger. Who doesn't wear a seatbelt these days?

  • Why would you need to tell insurance about a loss of demerit points that doesn’t result in your licence being suspended?

      Even if your licence was suspended, why would you have to tell them? It just means in the event of an at fault claim when you were driving, they will likely not payout based on fine print.

    • im ppretty sure when i signed up for insurance they asked me about demerit points (anyway for ctp they did) so i assume you have to tell them/?
