Not at Fault Claim for Car Hire?

Hi all,

I was in an accident and was not at fault. I don't have replacement car under my policy but is it possible to claim for car hire against the at fault insurer?

  • we just had to look in to it, the answer is yes and no, If they are filing a claim yes, if they aren't no. the person who hit us wasn't filing a claim, so we couldn't.

  • Make due without. There has been horror stories about individuals having to repay the hire themselves due to claims not being successful or just not recovering enough.

    Ultimately you are responsible and this becomes a civil issue directly with you and the other party (or their respective insurers) - your insurer won’t persue them on your behalf while they try to recover for the car, hence this service doing what they do. I could be mistaken, but they don’t take insurers to court to settle disputes like an ordinary accident (in the even at fault is subjective). Which falls back on the individual to pay if not successful.

    • My insurance has assessed my dashcam footage and are claiming against the other insurer.

      • If your insurer has agreed to cover your hire, that's all that matters.
        It's up to your insurer to chase the at-fault party (or their insurer).
        Make sure you have your insurers agreement in writing and check for five print like approved rental agencies and vehicle types

        • OP may hire a vehicle of similar class and get the other party to pay for the costs even if they don't have the option included in their policy.

    • Their business model depends on people being confident that they will not be chased for a bill if things go pear shaped.

      This means that unless you lied about how the collision came about, or did something to jeapordize the claim they tend to just chase the other insurer all the way to the courts (and they often do).

      I have yet to hear of someone being offered a car, and then chased for the cost because the claim didn't go through, so would love some examples.

  • I've used them once but would want to be pretty confident the other parties insurance was solid as you're on the hook for their excessive rental charges if they can't get it back from the other driver/insurance, and would unlikely use them again.

    Last time I was in this situation, I contacted the other drivers insurance and requested a rental vehicle while my car was being repaired. I mentioned I didn't want to have to go through a place like that again and they happily organised a rental through a local place like Hertz or thrifty. It's in their interest to provide one as it's way cheaper than what those other places charge (daily rates easily double, admin charges that looked to be in the hundreds etc )

  • Op, you may also hire a similar replacement yourself and add the cost to your claim.
