Insurance Issue - Please Help

So my mums car has been burnt in a fire. Still drives but back panels have been warped and melted. Police and firies attended got a report from firies.

She has guys address etc. no contact details though as police did not give it and said only license is needed.

Other car was at fault according to report.

Allianz are saying she needs to pay excess and they will try to chase up the other person by sending him a letter but she most likely won’t get her excess payment back unless he makes a claim with her insurance.

She has comprehensive insurance. This does not sound right!!

Is her only option to take it to court as a civil matter between other driver? I thought this is what insurance is for??

    pay the excess and let the insurance company sort it out.

    if you're not happy, then spend the time reading the terms of insurance .. it will all be written down accurately in your insurance contract without needing to get a range of crazy adhoc replies from an internet forum.

    If other party is identified and proven to be at fault excess will be refunded, pay it up let them do the job your premiums paying for.

    • The issue is they said that will only refund the excess if the other party responds. If they don’t respond then Allianz won’t refund.

    This is why I've not recommended Allianz in previous similar post. Had the same problem with them before, many other insurers don't do it this way. I dropped them after that.

      • Nope. This is why it's important to read your pds and not assume every insurance company, policy, coverage and process is the same. One would assume higher standards coming from a well known insurance company.

        • Isn't this how all insurance companies work? Don't they always ask you to pay your excess first so that you can get your repairs done instead of waiting for the other party's insurance?

            @geek001: No, as long as you can provide the at fault driver's details. Not every driver has insurance (unfortunately)

            • @kerfuffle: Interesting… I stand corrected. It would be interesting to find out which insurance would do this and which won't.

              • @geek001: I've made not at fault claims with AAMI and SGIC, neither asked for payments, only asked me when I can take it to the repair shop.

                A year after the claim, my insurance contacted me for more info for court (them taking at fault driver/company to court afaik) , still didn't ask me for payment. Haven't heard back since. My car was fixed a week or two after the accident.

  • You wouldn't waste your time or money taking someone to court for such a small amount of money. If they are not going to pay court is probably not going to change that.

      Her car was parked in carpark. His car was parked next to hers. Went inside the shops and came out to find firies, police etc. and his car completely engulfed. Due to the heat and flame her vehicles body and paint melted and warped etc.

      • What was the make of the other party's car? Any ideas on the cause of the fire?

        • An older style Mercedes. Completely destroyed. I have not read the report from the firies.

        That's why you never leave open fires unattended in a parked car.

      • Haha. Good call. Those are skin burns though.

        Your car washes up real nice in boiling water. May even get some dents out.

        (Acid and chemical would be corrosion or etching to a car.)
