  • Heloo..I news help.in this..my mom has been granted a visa on 4th May 2018. It's valid for 3yrs and has this restriction.

    She came to australia on 30 July 2018 and left on Feb 7 2019.

    She is now in india and wishes to come in August and stay in Australia for atleast 10 months..when can she come ..we would like her to come as soon as she can not violating this rule..is a 6mts exit enough?

      The calculator calculates the period on days, based on your mother's entry record, the calculator shows if she come on 12/08/2019, she can stay for one year long. However, this calculator is calculating the days very strictly, actually if your mother come on 07/08/2019 (which is 6 months after her last depart date), I think the immigration office would not treat it as a violation.

        Australia entry date: 01/02/2018

        Australia exit date: 19/01/2019

        She has her tickets booked as per which she will enter Australia again on 20/07/19 and intend to stay for 12 months

        Your calculator says that if she enters Australia on 20/07/2019, then she must exit on 31/07/2019 and can come back again on 05/08/2019

        However, if I understand correctly, the condition says that if after exiting from Australia if she has spent six months (which ends on 19/07/2019), she can enter Australia and stay for another 12 months continuously.

        Can you please share your expert opinion and preferably as soon as possible?

    • Hi Ankur

      Again, this calculator is calculating the days very strictly, actually if your mother comes on 20/07/19, it has been 6 months past since her last exit base on the month and date. As per my understanding, it should not have any problem if she enter on 20/07/19 for 12 months stay.

      I am not an expert of this condition, I just develop this software based on my understanding of condition 8558 for my own use and share with other people. For any legal consults, please contact the migration agent who holds the license.

  • My mom got get visa granted 1 March 2018. Her first entry is 12/5/18 and exited 30/10/18. She then return again 7/2/19 and intended to leave 5/9/19. Based on the visa condition 8558, will she be breaching the condition if she exited on 5/9/19? Please help.

      The calculator shows the last exit date should be 18/08/2019 based on your mom's entry record. 12/5/18-30/10/18=172 days, 7/2/19-18/08/19=193 days, 172+193=365 days, so it will be more safe if she can leave on or before 18/08/19.

    Good on you. Its a great development but i still need your help mate?

    My Mother was issued a 3 year visitor visa (subclass 600 )on 21st Sep 2017. One of the condition was 12 months in 18 months period which is hard for me to calculate & understand. So far she is been to Australia 4 times since visa granted. She just returned back on 26th Sep.Now we need her again as we had a break-in at our property & very stressed now. I am not sure if i can call her again for a month or so to support us and kids.
    Thisis her visits so far

    1) 9/11/17 to 5/2/18
    2) 26/4/18 to 27/9/18
    3) 11/12/18 to 30/3/19
    4) 03/8/19 to 26/9/19.
    Pls tell me if if she can travel again soon or not? Has so far she is good with her travel?
    Thinking to arrive on 7th Oct till 2nd Nov.

      Based on the provided entry records, the calculator shows there is no problem for your mother's next travel, and she and even stay till 23/04/2020 if she enter on 7th Oct.

    Firstly thanks a lot for this tool, the date policy was so confusing.
    according to this calculator my Mom should have been exit 22/08/2019 but unfortunately departed Australia 31/08/2019.
    does it mean she breach visa condition? she is planning to comeback Feb 2020, do you think it would be a problem to enter Australia next time?

    one more question, as visa condition says, Must Not Arrive After 12/02/2021, does it mean she can arrive Australia Jan 2021 and exit Dec 2021?

    • I do not think immigration office will make it so strict and count day by day. It should be fine if your Mom come back on or after on 28/02/2020. But for safety, better not make the stay at such risky situation and do not try challenging the policy with the border custom or immigration office.

      "Must Not Arrive After 12/02/2021" means you can even enter on 12/02/2021(if you have the days left for entering Australia), but for how long you can stay for the last entry, it depends on how many days you left without breaching the 8558 condition.

        • Yes, it should be fine, the reason why I suggested 28/02/2020 is because it will refresh your Mom's stay record for the 8558 condition and she will gain another whole year stay after 6 months leaving.

        Thank you for your replies. I have a query regarding same. I cannot use the software you have devised but can you please help me asap. My parents were granted Visitor 600 visa and following were their visit dates
        1st visit - 12/3/2022 - 31/10/2022 —-> 7 months 20 days = 234 days
        2nd visit - 9/3/2023 - 25/7/2023 —-> 4 months 17 days = 139 days
        period outside Australia in between two visits - 4 months 7 days. = 127 days
        So total 370days on shore but 18 months considered from 1st visit will be up on 11/9/2023.

        Can you please let me know if they have breached 8558 visa condition .. i.e 12 months in 18 months condition? If breached, will they be detained and questioned ? FYI The flights have been rescheduled twice since last 2 days due to incessant rains in India.

        What is the meaning of this Length of stay - 12 months from each date of entry in Visa document?

        Should I apply for any bridging visa before their travel journey on 25/7/23?

        Can you shed some light on this please?

    My parents have got visa from 16th Sep 2019 to 16th Sep 2020.
    The language used on the visa grant letter says nothing about the expiry however, it says MUST NOT ARRIVE AFTER 16th Sep 2020.
    It also has visa condition 8558 (12 months stay in 18 months).
    Length of stay : 12 months from the date of each arrival & travel is multiple entries.

    I am confused whether it means that even my parents come on 15 Sep 2020 & they can stay until 15 Sep 2021?
    Can you help me out mate ?

    Also they are already here now, came on 2/12/19 & leaving on 20/2/2020, should the 15 sep 2020 stay to 15 sep 2021 still be ok ?

      Yes, if your parents come on 15 Sep 2020 and they did not come before during this VISA validity period, they can stay until 15 Sep 2021.

      1. If they came on 2/12/19 & leaving on 20/2/2020, and then come on 15 sep 2020 again, they cannot stay until 15 sep 2021 and you need to use the calculator to see when they have to leave.

        I hope this should be ok as it satisfies :

        1) coming before visa expiry date of 16/9/20,

    My dad's Subclass 600 Visa (6 months) is expiring and he will be flying out soon. There's no 8558 condition listed, but he has previously had two 12 months visas with only 2 months gaps overseas.

    Is he able to get another visitor visa approved with only a short gap again you reckon?

    • So you mean he have got 3 VISAs totally? 2 for 12 months stay with only 2 months gaps, 1 for 6 months stay most recently? All of them are without 8558 condition listed?

      • Correct, 3 x subclass 600 visas. Only the following were listed. Is it not normal?

        8101 - NO WORK
        8201 - MAXIMUM 3 MONTHS STUDY
        8503 - NO FURTHER STAY
        8531 - MUST LEAVE BEFORE VISA EXPIRY

        Does that mean the 'must spend 6 months overseas' rule doesn't apply to him?

        • If no 8558 condition was listed on the VISA, you do not need to worry about the 12 months stay during any 18 months. But to my knowledge, immigration office would possibly consider why your dad apply the tourist VISA so frequently. If you have enough reasons to apply then you do not need to worry about. But the only thing I can tell you is it depends.

    My mum is holding visa 600 condition 8558:
    Granted visa : 22/08/22 to 22/08/25
    First visit: 13/10/22 to 16/04/23 ( stay 5 months 4 days)
    Second visit: 03/06/23 to 12/10/23 ( stay 4 months 10 days)
    Can my mum come in Australia on 17/2/24 and until 04/05/24
    And when she can visit again in the next period of 18 minths ( for example: can she back to Australia in June 2024 and how long she can stay for)
