Agent Stalling Rent Bond Back

I need some real estate advice as a tenant regarding our bond and the extra rent we paid.

We vacated our old apartment 8th December 2018. We lived in there for over 4 years and were first tenants in a brand new building. Communication has always been bad with the agent.

It has been now almost 2 months and there's been no contact from them regarding the bond or anything at all. We have written to them and nothing. We called and told us they will send us an email soon after we called asking for explanation on some damages, dirty ceilings etc. We had an end of lease cleaner and it's standing by if there were any reasonable things needed by the agent. It's been a week and again zero contact from them.

Feels like there's a lot of stalling. They mentioned if this is not sorted we might go to court but they are doing nothing about it. What are my rights regarding all of this? I'm a little fed up with their attitude. Should I go straight to court? I'm positive the damages are far less than what the bond alone are within reason.

Any property managers view on this would be very appreciated

    Have you tried to call the bond authority in your state to see whats up ?

    If you were in NSW I would advise you to apply directly to get your bond back from the department of fair trading. Here is the page that explains the process and here is the online rental bonds site where you apply. Is there similar in VIC?

    OP you live in VIC so when you placed a bond you would have signed a form so that the agents could submit it to the rental bonds authority. Upon final inspection you would have received a form to release it. if neither of these happened, then I'm willing to bet that your bond was never submitted and has been spent. In which case you need to advise the authority and take it to VCAT. If you did sign them all, speak to the RBA anyway for an update.
