Is it legal to discriminate based on height?

    • Don't think so. I assume these places do it to cover ongoing maintenance costs and its not a bad idea from a business perspective. The majority of people will be over 135cm tall and I'm not sure it says in any Federal or Victorian Anti-Discrimination Legislation that height is a basis for discrimination.

      • Don't think so.

Looks like Victoria is one of the few places in the world where it IS illegal to discriminate on height…

        https://en.wikipedia.org/wiki/Height_discrimination#Legislat…

        • Wow. Really interesting stuff, I didn't know that there was such a clause in the Equal Opportunity Act.

With that being said, there is an argument to be made that the different charges for height in not discrimination in that you are not being let into the attraction. Discrimination as a whole would reasonably assume that because of your height you would not be let into the attraction. Funfields is likely to argue that due to safety concerns, height is a major factor in who can go on such rides and in order to provide rides for people of that hight to the general public, the cost of rides would increase due to height requirements/limitations.

So its not Discrimination directly, but when interpreted in a particular way it may be considered discrimination regarding the entry fee to the park. Unless there was precedent in the Victorian Courts or persuasive precedent in other regions, Funfileds is unlikely to receive any sort of backlash for the pricing scheme.

PS Sorry for spamming, I never know when to stop regarding legal issues. And Wikipedia needs to be updates as the 1995 version of the legislation should be changed. That version has been repealed and should read as the Equal Opportunity Act 2010.

According to Victorian law, it is discrimination… You are treating people unequally, purely on their physical appearance.

So according to Funfields, a dwarf can only go on certain rides if accompanied by their parent for 'safety' reasons ?

    • The cost does seem to be inversely proportional with the urea risk.

I literally just went yesterday… sigh

Though I will say I had a good time. The rides were good, the wave pool was nice to cool off in the sun. Given that it was towards the end of the holidays, the wait wasn't too and for rides and the staff were all friendly. Nice time out with friends or family. Though of course, bring your own food. I assume like lots of these other attractions, onsite Food and Bev is CRAZY OVERPRICED. I didn't even bother to look.

    • Like any places of this nature, the food and drinks are overpriced. Tip for OzBargainers, there is a Macca's nearby which is only a 5-10 minute walk away if you want cheaper food, if you don't want to or feel like taking your own. I've done that a few times!

  • why there are no asian models on the picture?
