ING Misuse Of Promotions

I guess everyone with an ING account should have received a lengthy notice of change to terms and conditions.

I am wondering if the section titled "Misuse Of Promotions", is taking aim at Ozbargain? It is far from clear what they intent is.

If someone placed an ING offer on Ozbargain, could they then deny that if they so chose?

The conditions were sent out in a PDF, with copy and paste disabled, but follows below:

MISUSE OF PROMOTIONS

We're making the following change in relation to our rights under the
heading "Misuse of promotions" of section 7 of the current T&C's to take
certain action where you access promotions in a manner that, in our
reasonable opinion, is not satisfactory or not in line with the intent of
the offer so that paragraph paragraph in the updated T&Cs reads…"

    They actually mention ozbargain in the email offer fine print…this is from the bottom of one of their emails…you can check out one they sent to you.

    If you use this offer in a manner that is not satisfactory to us or in line with the intent of the offer (such as sharing your referral code on the 'OzBargain' website or other similar websites, or advertising or marketing your referral code), we may refuse to pay the cash bonus (including in respect of any or all referrals made in relation to the offer). This includes conduct on your part which is designed to undermine the fair and intended operation of the offer.

  • Sounds like they're just trying to protect themselves from abuse.

    Usually, in the T&C's, they would list a number of exclusions or conditions that don't qualify, but in this case, they're trying to cover themselves in the event that someone (us!) does come up with a loophole that no-one there has thought about.

    I personally don't see a problem with it, unless they themselves start not honoring their own promotions (within reason, of course).

      They only want to splash cash on recruiting new customers and sod the existing ones. Ozbargainers are probably a bad demographic too, with less brand loyalty.

    I recall ING stopped a number of accounts where the holder was using it to withdraw $200 to get the $0.50, over and over, in the past. Yes, they are trying to cover themselves for uses not according to the spirit of the offer - which seems fair enough.

    So, even though many have suggested 5 x 1c transaction each month to fulfil their T&C, and so far, it has been OK - just to be safe, I usually make transactions with larger amounts.

    • I did the 5x 1c transactions at Woolworths self service checkouts (at off peak times), but recently noticed their upgraded terminals now require operator intervention if you select split payment. The older models still allow it.

      There's a really easy way for ING to resolve the problem: Make the requirement that you need to spend $X on the card per month. Problem solved, and gives an easy target to aim for. Just saying '5 transactions per month' allows the 5x 1c transactions.

      • If all split payments require operator intervention (with upgraded terminals), that would be really annoying.
        People legitimately want to use more than one mode of payments. Say, if you run out of e-gift card credit, you have to use other split payments.

        Perhaps it is just limiting the number of splits, or splits of a type (e.g. 3 e-gift cards allowed)? Any idea?

        'require operator intervention' - are you sure?

        I know for the last few months that it first defaults to card payment for the whole amount, then if you press 'Back' or 'Other Payment Type' a message comes up on screen that says something like 'Card operator cancelled'. Then I press 'Ok' and leave it for a few seconds (10 seconds or so) and then its possible to select 'split payment'

          Yes, this is what I have been seeing. Is this the upgraded terminal?
          Then it is OK, you can still split as many times as you like.

          • @bluesky: I have seen that it automatically goes to eftpos terminal when you select "Card'. You need to need to click 'Cancel', and then click the 'Back' (arrow) button. Then 'Card (split payment)' is an option.

    • I have never done that. They should pay the rest of us tht don't use that benefit an average amount to compensate.

      Also, I want to know how exactly ING can pay 50c. I want all these interchange fees made public. We should know how the banks are ripping us off.

        In the past, it was probably beneficial for ING to incentivise use of EFTPOS for withdrawal - because otherwise, they would have to reimburse the ATM withdrawal fee, if customer used ATM machine for withdrawal - a bigger amount than 50c. This was before the big banks removed ATM fees for non-customers.

        This benefit has remained.

  • This clause isn't new and has existed in their terms and conditions for years. They just updated it slightly to say that in addition to voiding the promotions if you're abusing them, that they can now also close your account.

    I did 5 x 1c card purchases on 1 Feb. It said it settled on 3 Feb. I have looked at the 'How about next month' indicator for 'have you unlocked card features' and it still shows 'Make 5+ Settled Card Purchases' as not completed. But it was 'Last Updated' 12am Sydney Time Feb 4' (i.e. 1 hr ago).

    It could be a process that still has to complete but this may be something they have done with regard to this. I was always suspicious when I got that email. Meh, if they don't recognise it, then its a good enough time to open a UBank account. I will check again in a day or two.
