Fine Payment before Review Complete

Hi all

Just wondering if anyone has any idea.

I have a penalty notice (completely legit) which I have put in a request for leniency for.

I've not received a reply from revenue nsw as to whether or not this request is successful (its a long shot!).

Penalty was due yesterday. Not sure whether to keep waiting or just pay the penalty.

Anyone know how long the due date is put on hold whilst the review is in process? Can't find much info online and hotline is closed.

  • I once had a parking ticket for not paying a parking ticket but I did. It just it fell off the dashboard.
    I emailed the parking company telling them my ticket ID to say that I did purchase a ticket. Fine was due in a week.
    Sent a bunch of emails saying what to do, kept getting no replies from them so I ignored it and didn't pay.
    6 months later they replied to the email and just said to ignore it.

      Parking company fines are usually insignificant and are not the same or enforceable as fines from govt entities

      • Yep in Adelaide unless it's from the city council you don't have to pay it. It even says on the ticket this is not a fine (if it's from any private company).
        For OP I've had a few fines that had been held up for various reasons. As long as you submitted a request and they received it before the due date. All is good until they reply.

  • If you pay the fine you lose any and all 'bargaining power' you may have once had. There's no reason for them to waive it if you've paid

    • This is not correct.

      • I'd be glad to be found incorrect because that would show that whoever issued the fine still followed due process.
        I took the pessimistic approach just in case.
        It would be like transferring funds to a car dealer's account then negotiating a discount .. all leverage lost.

          I don't think the OP is disputing that the offence occur but rather asking for out to be converted to a caution.
          I am in Victoria and did the same once. I got a fine for speeding 6 km/h over.

          Paid the fine on the due date while waiting for an review outcome. got approved after paying. got a refund cheque in the mail.

        • The person who issues the fine does not and is not legally allowed to review it.

    Call them?

    Once wrote in a letter explaining the circumstances of the speeding ticket issued by a fixed camera. Due date was approaching with no replies, so I called and they said they're currently reviewing and not to pay until we hear from them.

    For stuff like this, you want reliable answers from the source.

  • Victoria has a web site to track your fines - Fines Victoria. It can be used to view images, request extensions etc.

    Similar to OP's situation, the letter acknowledging review request took ages to arrive.

  • By law you get a reminder notice. Check online to see if your review has been received, if it has it will say the matters on hold.

    You can pay if you wish and they will refund or wait till the end reminder due date. Your call.

    Paying does not change your review outcome.

  • Thanks for the replies. Looks like I can just wait for now. From what I gather on the website, they will send a reminder notice anyway before charging arrears / late fees.

  • CALL them on Monday. Knowing Australia post at this time of the year, the review outcome might have been lost.

  • delays of 6 weeks are not uncommon. You can request the reply correspondence via email.

    Also you can send an email and ask if the review has been received.

    I had the same thing. Speeding fine which I wrote a letter saying blah blah. Didn't get a response before the due date so I paid it. A couple of weeks later I got a letter saying it had been overturned and I would get a refund of the amount I paid and my demerits points reinstated. So I would pay the fine and if they do let you off with a warning they will refund the amount paid

    • Once you submit your request for review with Revenue NSW the fine goes one hold until you receive an outcome. Check your inbox and spam every week or so for a reply, but it can take up to 6 or 7 weeks. You'll also receive a penalty reminder notice with a further 28 days to pay or court elect if you get an outcome that determines the fine stands.

  • I have had the same thing. Fine payment is typically not required until a decision is made. If you sent a letter asking for review, fine payment will be put on hold. Just hold off paying until you have an outcome. I have had success in admitting guilt and asking for leniency. They will eventully send a letter saying payment is not required until a decision has been made.

  • Took vic camera office 4 months to get back to me to tell me fine had been waived. Though they did send a notice saying everything is on hold until review complete.

    ANYBODY caught speeding for the sake of speeding should have NO MERCY SHOWN towards them and they should have an extra payment on top of the speeding fine,anybody that gets behind the steering wheel and drives off know that they they have a large weapon that can kill or maim innocent people,like your Mother your Father your Brother/Sister your girl/boyfriend your Fiance is dead in the car you hit or made someone else have the accident that killed them,I received my first license in 1961 20yrs of age,I have only had one speeding fine in my 56 yrs of driving,it was back in the early 1963,the speed limit was the 30mph and a motor cycle cop pulled me over thinking/hoping I was DUI and when realized I was not committing any driving offence he decided to book me for doing 33mph across the Harbor Bridge in Sydney,as I said the speed limit was 30mph,I never heard anything about the booking,I later found out the Desk Sargent would have thrown it out but that booking was still on my file back in 1998,I also have never lost any demerit points. SLOW DOWN YOU FOOLS YOU WILL NEVER REALIZE WHAT YOU CAN LOSE YOU CAN LOSE YOUR SIGHT HANDS-ARMS—YOUR LEGS AND YOU CAN END UP IN A WHEELCHAIR IF YOU ARE LUCKY OR MAYBE YOUR INJURIES ARE SO BAD YOU SPEND THE REST OF YOUR LIFE LIVING IN A VEGETATED STATED UNTIL YOU DIE FROM OLD AGE.

      • For the record. Not a speeding fine. Just forgot to pay my rego renewal. :( speeding fine would have been much cheaper
